Justnan, thank you for your information!! Well they can't pay out some people and not others, tell your daughter to e-mail them back regarding payment

I think you'll find that they can and do!

Remember Mr Ronald Huzar, he won his case in the Supreme Court, but apparently Bott & Co are still trying to gain compensation for the rest of his family members on the very same flight!!

    Unbelievable but true!

Because they're allowed to. The only people who compel them to respect the law are the courts, but that doesn't happen proactively: only when a claimant sues. Which is why, if you have a legitimate claim and the airline is messing you about, don't engage in fruitless correspondence or try to find examples of a previous successful payout: these won't move the airline. Just take them to court.

..... And just because they have paid out to one passenger does NOT force them to pay out to another passenger on the same plane, the airline and sometimes the Courts deal with each case before them on the evidence that is presented and the Judge may not be aware of other cases relevant to the case.

That's why it's important to represent YOUR case to the best of your ability and certainly if you have information about another Court case about the same flight, then do bring that case to the Judges attention, but the Judge is NOT obligated to follow any previous Judgement in another County Court.

    Cheers,

Well I hope that it will now be unnecessary as I just received a telephone call from home to say that we received a letter this morning:

As per the court order dated XXXX ( for the 2nd time) we have contacted our client for the sum of XXXX and once we are in receipt of the funds we will pass them on to you.

Yet again I won't count my chickens until I have the cheque, but it's another step forward.:)

Another week forward and still no funds received, the saga continues!!! :(

TCX163 anyone on this flight? Coming back from
Cancun to Manchester on 11 July 2013.

Just noticed I typed in TCX162 in previous messages, that's why there is confusion with my claim!!! So that's why TC are still not paying out. The CAA have investigate the wrong flight!!! Starting to loose the will here!!!!
