    Hi was the this the plane that came back after 2n half hours after it left? I was on the plane after that which I got compensated for.
  • I am also pursuing an EC261/2004 claim for compensation for this flight delay.

    Like Tireless my initial claim was rejected and then I received notification that the claim would be reviewed in the light of the Supreme Court decision. I also lodged a complaint to the CAA and received the same advice as Tireless.

    On 5th January 2015 my claim was again rejected on grounds of extraordinary circumstances beyond TC's control.

    I have lodged a claim in the Small Claims Court using the government Money Claim on Line service , cost £60. TC have elected to defend the claim and I am currently awaiting a date for a County Court hearing. I have deliberately chosen not to use a claims handling company.

    I would be very interested to hear from any others seeking compensation for this flight delay and to learn of their experiences.

  • Hello all, my husband and I were delayed by 24 hours on our return flight from our holiday in Cuba, over 5 years ago now. I first tried to claim compensation in March 2010 citing the EU261/2004 regs and was politely told that they would investigate. As a result they quoted all the tosh about the Association of European Airlines etc., etc. Cut a long story short they declined to pay. On dipping into MSE late last year I saw that a decision has been made regarding 'technical faults' and now a lot came under the 'compensation' heading. I took the sample letter, doctored it a bit and enclosed ALL my other documents again and lo and behold, they wrote that they would now be implementing the decision of the Supreme Court in the Huzar vx. Jet2.com case.


    I was over the moon, until today! I received 2 letters from Thomas Cook, the first states that we are entitled to £870.00 compensation, however they would be paying this in the form of a voucher to be used on our next holiday. This very obviously means should we wish to travel again, we must do so with Thomas Cook.


    My query is, do I have to accept said voucher or can I demand a cheque or similar?


    I've been fighting this for 5 years now and I really would like to draw a line under it, please help!

    In the Daily Telegraph - Travel Section - June 2014
    A spokesman for Thomas Cook Airlines admitted it sent vouchers to some customers "unless they specified they wanted cash".
    "If the customer requests cash during the process, or would rather have cash after we have offered vouchers, we exchange this for cash, so it is always ultimately with the customers' agreement," he said.

    There are hundreds of post all asking the same question - No you do not have to accept vouchers, phone them up and ask for the queens coin of the relm. I would also check the entiltlement at the time, 600 euros each at the exchange rate at the time, which was good so check what they are offering. I would also get my skates on as you are nearly out of time 6 years.

    The delay you had was the return flight back to Manchester that I was outbound on. The weather radar failed 3 hours out into the Atlantic and we returned back to Manchester for it to be repaired.
    It then failed again an hour before landing in Cancun hence the delay on TCX 163 that you were on back to Manchester.
    Bott & Co have received the usual response for my claim that it was a 'manufacturing defect in a replacement part' .
    They are therefore issuing court action against Thomas Cook.

    I rang Bott and Co about my claim with this flight and TC have till 9th April to respond to the courts with a good excuse ! Just have to wait for the outcome.
