Flight delay and cancellation compensation, Thomas Cook ONLY

Are people hearing back from Thomas Cook and if so how long is it taking?!
I wonder if they may argue I don't have enough evidence or it is too long ago - flight to Morocco delayed 5 hours on 2nd July 2008.
They have replied but asking for invoice/airline ticket/boarding card and of course I don't have any. I do have a stamp in my passport showing the 3rd July 2008 (so late we arrived early hours of the next day!) and I have bank statement showing the money we paid TC.
I responded to the email that they sent the same day they contacted me - 17th Feb.
Although, I have sent 3 follow up emails asking what the situation is with this case I have not heard anything back from them at all.
Is anyone hearing anything at the moment? Do people think this is too far back?
Could be tricky as websites show est. time of departure/arrival but they are incorrect. We left the stand at the airport on time but before take-off we returned to the stand due a technical fault and had to disembark.
Thoughts? Thanks!0 -
Lock5 - forget it they are winding you up - if delayed over 6 years ago and no court claim = no chance.0

My fight with Thomas Cook is regarding flight TCX255 Barbados to Manchester 02/12/11 and basically after many delaying tactics (asking for verification of boarding details, documentation - CLEARER documentation! which dragged on for months!) and originally using the excuse of 'circumstances beyond our control' they are now refusing compensation on the grounds of 'a technical fault due to extraordinary circumstances' i.e. due to 'manufacturing defects....not affected by the court ruling' and basically told me to go to the CAA (which I have done) saying they've reviewed my case a number of times and feel 'confident' in their decision to refuse compensation. I find they've been moving the goalposts when the courts are ruling against the airlines. Very irritating but I've told them bluntly I am willing to go to court over this!0

Have a read of Vaubans superb guide, if you've not already, issue them with a LBA and then start legal proceedings. Then they will start treating you seriously.
Do not play letter ping pong with them as you are wasting your time and running down the clock.
Good luck. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

It is described by the court that "A flight is not covered by the concept of ‘extraordinary circumstances’ within the meaning of that provision, unless that problem stems from events which, by their nature or origin, are not inherent in the normal exercise of the activity of the air carrier concerned and are beyond its actual control." If you believe that your flight delayed due to normal technical failure then you should go for legal proceedings.0 -

They must have had a lot of plane faults that month from Barbados. I was delayed over 26 hours on the 16/12/2011 from Barbados to Gatwick and the passengers on the 17/12/2011 were delayed over 50 hours. Pretty regular really and not extraordinary at all. :mad:0 -

We've been offered a voucher as compensation for a 13hr delay that we suffered last year. This is fine as we have another holiday booked, however this new holiday has been booked through Thomas Cook but with Cosmos and they are not down on the list that can be redeemed. Do we have to accept a voucher or can we insist on cash ?0
