TCX313 11th Sept 2011. Calgary - Manchester. 23 hour delay.
After just over two years of frustration (on my part), delaying tactics and obfuscation (I wonder who that might be...), I finally have compensation from TC in my bank account.
Surprisingly, it has only taken 7 days from admission that compensation is due and an offer of vouchers, so TC can do some things quickly...
The moral of my story: be persistent and bloody minded, don't be put off by the CAA, and have some documentation!
TC actually admitted in writing to an "operationally significant defect" when we disembarked in Manchester, but then continually refused to admit that compensation was owed. Brought in the CAA, but they sided with TC. After the Huzar ruling, TC suddenly could find no record of my wife and me, despite having previously conducted "a thorough investigation."
Finally managed to track down an original booking confirmation last month, which included the booking reference that TC have had since day 1. Heard nothing for three weeks and then received the email offering vouchers. Happy Days:j
In my excitement I completely forgot to thank everyone who contributes to this board. Your advice, successes and failures have kept me motivated to continue over the past couple of years.
And yes, TC always offer vouchers first, but you don't have to accept them. You have to telephone but they have to pay you in cash if you ask for it. I did and the money is safely stashed in my account now:jIf at first you do succeed, try not to look too surprised0 -

I have today received a cheque for flight delay compensation for our family of 4 AND they had to pay us at the Euro exchange rate at the time of our flight! Winner winner chicken dinner.

Our flight was TCX5245 Corfu to East Midlands on 26/08/13 and was delayed over 6 hideous hours. The captain blamed a bird strike causing damage to the nose cone and subsequent computer damage, blah blah blah.
So the day after we returned home in 2013 I started the compensation process as described in these forums. Got the standard brush off letter back from TC. At this point I had a choice, either fight myself using the information shared on MSE or use a NWNF company. I chose the latter as I didn't want the stress and hassle. After a year they still hasn't got anywhere so they referred me on to their partner solicitors. Eventually, 19 months later the solicitors were successful!
And yes, I had to pay a 25% fee but I didn't become all consumed by it and it was stress free. This is just my story to give you hope. TC apparently used every delaying tactic in the book including taking 8 weeks to pay up after agreeing to settle. Good luck.

Just to let people know. I applied in February for a flight delay from Turkey to the UK in September 2010. I did not have any booking reference to hand, the only thing I had was a visa on my passport. We were delayed overnight, really spoiled the holiday and cost us days off work, so was not acceptable. I have today received a voucher for £590, but have asked for a cheque as I have already booked a holiday this year and the voucher runs out next April. Not bad for a couple of letters, they do tend to not reply for ages, but don't give up. Keep writing and look at Vauban's guide, was very helpful. Good luck.

Morning All, after the DJ handing down a decision in my favour 6 weeks ago Weightmans still haven't sent any funds. I contacted them 2 weeks ago and told them I was now another 4 weeks interest out of pocket and that I intended to escalate to the High Court if the funds were not on there way. Had a replying stating that due to the high number of claims being processed the payment would never have been forthwith, and its out of there control. I was told that TC had processed it but I would get settlement forwarded once they had it. That again was 2 weeks ago.... Is it now time to send in the Baliffs for my settlement? And do I get the £60 High Court fee back?

So first they delay your flight, then they delay and frustrate your justice in getting compensation, then they delay actually payment. No surprises there then.

Thought I'd give them one last chance. Emailed the solicitor in question and I get an out of office notice until next week. Please contact the email below, so I did and another out of office notice pops up. Says it all really, what a sham of a company. The only thing I am worried about is that the High court process can take up to 6 weeks. If I receive payment in the interim I am still liable for the costs.0
