  • Suffered a flight delay in 2012 from Belfast to Tenerife. After a few letters back and forth from 2013 for about a year I then decided to - for the first time ever - rely on the good old travel insurance as it said legal cover was included. So I wrote off to them and put it on the back burner.

    The travel insurance appointed a solicitor firm to cover this. After a few more letters/forms back and forth we didnt seem to be making much progress. The solicitors seemed to be basically doing what I had done previously and TC delayed everything as much as they could and referred other court cases pending etc etc. Now I think the solicitors have become as fed up as a lot of others here and I have just recently filled in a Statement of Truth form which is likely to go to a county court in England ( unless TC pay up beforehand). I'd like to think that seeing as they are dealing with solicitors that they wont fob them off with a 'manufacturing problem' excuse.

    Recieved email from Bott and Co Thomas Cook standing there ground no compensation on result of it being a manufacturing defect on the radar ? So waiting directions from the courts on a final hearing before the judge.

    Just paid Court hearing fee whilst continuing to tinker with my court bundle when I receive a full and final settlement figure from TC who had apparently reviewed my case. I'm happy with the figure but just wanted some advice as was planning to simply advise the court once payment by cleared funds was received (I'll avoid the temptation to ask if i have to accept vouchers!) but I've been requested to file a Notice of Discontinuance, does that sound the correct procedure?
  • I suffered a flight delay between Rhodes and Gatwick in July 2010. I complained at the time, but I never received any response from TC. That should have been a sign.

    I complained again in October 2014, but I didn't have a booking ref or a ticket stub, and they denied being able to find me on the flight, despite me having the flight number, full passenger names and the times of take off. I rang on multiple occasions, and my travelling companion went into the store where we booked to talk to them, but they denied all knowledge of the booking.

    After much searching, I managed to find a itinerary summary ticket stub thing which has my booking reference which I've sent to TC on Easter. The last few times I've had emails back from them, it's taken a couple of days. My question is how long should I wait to hear from TC before I send another email?

    Only file the Notice when you have received cleared funds.

    TCX313 11th Sept 2011. Calgary - Manchester. 23 hour delay.
    After just over two years of frustration (on my part), delaying tactics and obfuscation (I wonder who that might be...), I finally have compensation from TC in my bank account.
    Surprisingly, it has only taken 7 days from admission that compensation is due and an offer of vouchers, so TC can do some things quickly...
    The moral of my story: be persistent and bloody minded, don't be put off by the CAA, and have some documentation!
    TC actually admitted in writing to an "operationally significant defect" when we disembarked in Manchester, but then continually refused to admit that compensation was owed. Brought in the CAA, but they sided with TC. After the Huzar ruling, TC suddenly could find no record of my wife and me, despite having previously conducted "a thorough investigation."
    Finally managed to track down an original booking confirmation last month, which included the booking reference that TC have had since day 1. Heard nothing for three weeks and then received the email offering vouchers. Happy Days:j
