Flight delay and cancellation compensation, Thomas Cook ONLY
Comments

Phil, as Mark2 says its not us forumites, its because the airlines and the legal system to an extent, choose to ignore any sort of precedent set by sucessful claims on the same flight.
As an example take Mr Ronald Huzars case, he with the assistance of Botts went all the way to the Supreme Court for payment, yet AFAIK Bott are still chasing payments for other family members on the very same flight.
So even with a Supreme Court ruling, it's not straightforward just to say well you paid out on this case, you should pay out on every other case, even when they set a precedent as in this one.

I would agree, unless there is someone on this forum on the same flight as you that has been paid out then the chances they are not going to tell you. The only way that will happen is that when the judge gives directions make sure this question is asked. In my case the judge asked the defence are there any other cases for this flight, if so what was the outcome? They said no they were not aware of any but a friend of mine was on the flight and had gone to Bott etc, also when i phone the court about something else they told me they have a stack for my flight! so don't expect any easy ride from the airlines, they will not cooperate unless they really have to.
On a footnote, they take each case on its merit, in mine I had them by the nonads but someone elses case might not be so strong even for the same flight. They paid out before court so it did not go on the record.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)
Thomas Cook Claim - Settled Monarch Claim - Settled0 -
The bottom line Phil is that you'll only get your money by starting legal action - which you've done, if I understand it right. There's no harm, as you say, in seeing how others have fared. But only in the context of your own court claim.0

I have a similar problem. My wife and I were on this flight and our first approach to Thomas Cook for compensation was turned down due to 'extraordinary circumstances'.We therefore destroyed all our evidence of our flight believing there would be no further need for same. Of course, the newEuropean Ruling Reg.261 has now over-ruled Thomas Cook's decision but T.C are now demanding from us,proof that we wetre passengers on the flight and have asked for boarding passes etc in this respect.I have tried unsuccessfully,to resurrect our original booking with Canadian affair only to be told that their records do not go back that far.I have also been in touch with West Jet in Calgary, only to be told the same story .I am now trying to get the a copy of the passenger list from T.C. with a 'Subject Access Request' which I have posted, recorded delivery, today. Can anyone else suggest any other route I can take??
QUOTE=hilger;60434567]Can anyone help please? Myfamily and I were on TC flight ‘TCX031L from Calgary to Manchester on 10thSeptember 2010. Our flight was delayed for a total of 48hrs. Without going intoexact detail my first letter of complaint resulted in an eventual reply to theeffect that all this talk of compensation was down to media hype and that Ishould be a good boy and go away. Following the subsequent EC judgements TChave now fallen back on the ‘EC’ response but have since failed to respond tomy correspondence including an ‘NBA. I have forwarded my complaint to the CAAand await their response before progressing through the courts. However in themeantime I am trying to research the particular flight and the reason for thedelay.
Two issues I have are:-
1) I can find no record ofthe flight on the ‘Flight Stats’ website. and,
2) Were any other ‘readers’on this flight and what the outcome of any complaints submitted. [/QUOTE]0 -
Hi Phil, ive sent you a private message about that Hurghada flight, im still pursuing Thomas Cook to admit fault! ive got Bott & Co on the case though and hoping theyre going to start proceedings soon as Thomas Cook just seem to stall at every opportunity.
Dont give up though...lets make them pay!!!0 -
I would be grateful if anyone could help on this one: My family had an 8hr delay, travelling from Antalya to Manchester,on 07/06/2010.
Although I have my flight number etc,I don't have a booking ref. ( the holiday was booked online.
Have contacted T.C. today, who say they have no record of our travel.
We are certain of the dates & flight number.
How do I prove we were actually on that flight & proceed from here?
Thanks in anticipation.0 -

Pleased to say I've arrived at the end of my journey
Brief back story is- 20hr delay in November 2014 - Faulty Solenoid
- Online claim made the day after the return date (auto acknowledgement
- <long wait>
- "compensation e-mail" came with vochers
- Same day : Vouchers rejected with a request for cash
- <long wait>
- Phoned their Customer Services and pressed the wrong buttons so I actually spoke to someone.
- With my 'nice as pie' head on politely asked for an update and explained the situation (7 min call)
- Call Taker apologised for the delay and told me that a BACS payment would arrive in my account within ten days
- Seven days later the payment arrived
Time elapsed --- 5 Months all but one day0 -
Phil, no-one on this forum has any problems at all with you establishing a link with a fellow passenger if it makes you feel better.
We are just trying to kindly point out that it won't help you achieve a legal result.0
