About time and way over due.
“The findings of the scheme will be binding on airlines,” the CAA said.
“This has not been true of the current CAA complaints process and some airlines have continued to refuse to pay compensation to consumers despite a CAA ruling, forcing consumers to take court action.”

Great first result! (Obviously not necessarily a crushing blow yet as this judgment although persuasive is not binding etc.)
Nice to see Bott & Co have changed their minds too, I am going to need a new stock phrase when I talk about them from now on because they "[STRIKE]perhaps[/STRIKE] really do know something after all".
I particularly like this bit from the HH District Judge lyer:
“Bird strikes happen every day, in fact many times a day, and would hardly be worthy of comment but for the delay which they cause. They do not fall within the same category as a motorway collision between a car and my previous example of a horse, which would be extraordinary for the simple reason that our skies are populated with birds, whereas our roads are not populated with horses.”
(My emphasis).
Had Thomson bothered to face me in Court they would have had most of that reasoning from the Judge thrown at them.The above is just my opinon - which counts for nowt! You must make up your own mind.0 -
I used a compensation company and it's been a bit of a long slog, but I recieved an email today saying Thomas Cook have now agreed to pay compensation and I have to contact them directly.
They warned that they will try and give vouchers, but I can ask for the cash equivalent.
What are they like at making payment? Do they drag it out as much as possible or are they ok once they have accepted a claim?A smile costs nothing, but gives a lot.It enriches those who receive it without making poorer those who give it.A smile takes only a moment, but the memory of it can last forever.0 -

Thomas Cook emailed me in December to say I was getting comp. in January they offered vouchers. Have been emailing since requesting cash. Still no reply. Don't have a phone number that I could ring them on. Any suggestions?0

A notice of discontinuance would be appropriate where the airline had agreed to settle before judgement. But - and I defer to legal minds - it is irrelevant where the case has concluded with a judgement. Once a judge has ruled, and there is no appeal, the case has concluded, surely? The Court doesn't need advising of the fact.
There's no need for a notice, there is a Court Order that should have wording that the case is settled.0 -
