Whats the average wait time after a settlement has been agreed ?
Weightmans via our solicitors (NWNF) offered full and final settlement including interest on 26 March 2015. Our flight delay was July 2013.
Posted on here end of March the happy news, but we are still waiting for our payment? Have emailed our solicitors a couple of times and they are saying can take this long as Weightmans have such a back log? But its been 6 weeks today!! Is this normal? Ive had a moan at my solicitors saying I accepted interested up to and including 26 March but now we are May and still no monies have been sent.
Am i just starting a new waiting game!?0 -
:j Success at last! Finally got my payment through from TC, thanks for all the advice, and stick with it those with genuine claims, from the summary of my claim below many people would be put off pursuing compensation...
18th September 2014 initial claim submitted through TC website
Various chasing and fobbing off pending Huzar outcome, but at the time TC were stating my delay was due to a technical fault.
More delaying tactics until my NBA on 9th December prompted a response that my delay "was caused by a manufacturing defect of a part we had replaced on the aircraft."
Request for a copy of the aviation report was ignored and I then submitted to Court.
Court Defence received mid February and had dropped the manufacturing defect and gone instead with a steering link failure, however this was on a different flight over 24 hours prior to my own flight and in a different country!
It was only after I paid the Hearing fee that TC offered to settle in full. Even then this was later than the 21 days stated for payment but was paid straight into the bank.

Me thinks it is time someone started collating all this evidence of blatant untruths/lying by the airlines in their "defences".
The CAA and Juduciary should be informed.
Alas I have no confidence that either would do anything about.

Is there anyone else who was on this flight?
This was a TC chartered flight by Canterbury Travel and was due to leave late afternoon on the 15/12/2011. As we got to the airport we were told there was a problem with the plane that was coming to pick us up (the antifreeze unit had failed so it had to return to the UK to be fixed). The plane arrived about 00:30 on 16/12/11 and we arrived at Manchester Airport via Gatwick about 4am.
I've contacted TC regarding this and given them the full names of the 9 members of the party, airports concerned and flight numbers, but they have dismissed my claim as I dont have a TC Booking Ref.
Having spoken to the Canterbury Travel they said there isnt a TC booking ref as it was a chartered flight so went back to TC and said I didnt have a booking ref and the reply was "we cant proceed with investigation without it"

I travelled Thomas Cook flightTCX1364 on 11/05/13 from London Gatwick to Paphos Cyprus expecting to depart at 07.10 this flight arrived seven hours late at Paphos airport. In March 2014 having looked at this website I decided to make a claim for 1600 euros for this delay for myself and my other three travellers using the proforma letter provided. Thomas Cook rejected my claim. I contacted the CAA who upheld my claim, wrote again to Thomas Cook who again said no. (I know many on this site think the CAA are useless!)
In view of the pending court cases I waited for the outcome.
Having seen the posting on this forum, on 17/11/14 I wrote to Thomas Cook asking them to formally review my claim. On 10/12/14 they requested copy of the tickets which I supplied on 11/012/14 was advised I would receive my compensation within 28 days. On 08/01/15 as expected they sent me a holiday voucher for £1280.00 I contacted Thomas Cook and declined the voucher stating that I was entitled to a cash payment I was advised this was not a problem they took my account details and said it would take 28 days for it to be put into my account.
The £1280.00 arrived at 28 days – Result!!
I have had two other successes with Thomas Cook. in February 2014 I was on a Thomas Cook flight from Gatwick to Barbados to join a two week PO cruise. The entertainment system did not work properly, and did not work at all on the return flight – Thomas Cook had not repaired in the two weeks. The flight was also delayed but not enough to claim. I made a complaint via Thomas Cook website as there had been several problems. Eventually I spoke to a Customer Service officer he advised me there was a standard compensation of £30 per person per journey when the entertainment service is faulty. Thomas Cook paid a total of £240 cash for me and my three travellers.
In February 2015 I was on a Thomas Cook flight from Barbados to Gatwick my and many others entertainment system did not work. I made a complaint claiming £30 compensation. I was advised that this year the compensation was £20 which I accepted as cash. The outgoing flight was delayed by 2.45 but could not claim – Thomas Cook have a really bad record unfortunately sometimes one can’t avoid them.

Follow Vaubans guide and issue a NBA/LBA, that should get their attention and show them that you are serious.

I then corresponded by email, provided bank details and gave them until 8th May to pay failing which I requested ongoing interest.
Payment received by BACS on Friday 8th May for just under £1100. Email communications with Weightmans Glasgow office was quick and helpful but I responded quickly and provided documents requested so I think this may have helped to push things along. Good luck0 -
My daughter has been in touch with Thomas cook about flight delay compo and they want proof of the flight (i.e.boarding passes etc ) however,the flight was in 2010 and I would assume that no-one would save all documents for 5 yrs.Any advice please?0
