I have sent a Subject Access Request (SAR) off to Thomas Cook asking for the passenger loading list for the TC flight in 2010 where we were delayed in Calgary for almost 48 hrs, since I too, do not have the 5 yr old documentation that TC are insisting upon..

Apparently they have 40 days to respond .I wrote on 21st April, recorded delivery,so they still have a few days left to respond. I will update here when and if I hear further from TC.

Just be careful that you do not go out of time to start a claim.

You MUST have commenced court action before 6 years are up, - seeing a Mac on your handle, I'd better make sure you're aware that the time limit for making a claim is FIVE years in Scotland?

I was also on this flight and sent the standard letter but have not received a reply as yet, if I get the same reply as you I am definitely taking the next step as it was totally unacceptable. I will let you know what they reply to me.

I'd definitely be interested to hear how you get on.

It's been a week since they re-opened and so far no reply, I'll be giving them a few more days before chasing. I've also contacted the CAA, however based on posts I've seen on this forum I suspect that won't get me anywhere.

Me and the wife have already decided to go down the legal action route if necessary, it's the principle of the thing if nothing else.
  • I was offered vouchers as compensation. I rang up and requested cash. No problem. Was in my account in ten days.
  • hi sarge just saw your post we were on tcx6815 27(28)04/2015 getting same runaround off tc customer (dis)service dept

I've just returned from holiday, had a 5 hour delay going out. I have been trying, unsuccessfully, to find an address for TC to send the template letter to. Spent 30 mins on an 'online chat' only to be told they don't have an address they can give me!!! Does anyone have one, other than email or online form please?

Off the bottom of the emails I've had from them:

Registered Office: The Thomas Cook Business Park, Coningsby Road, Peterborough, PE3 8SB

    Hope this helps.

I knew we wouldn't be the only ones dissatisfied with the response.
  • I have had 2 e-mails from Bott today .The first one says that they have been successful with my claim and the second one says they need the bank details of all passengers and an e-signature.
Are these genuine as I am loath to divulge bank details.I have a claim with them for a delay with Thomas Cook.
    Any advice would be appreciated.

If you have had confirmation back from B0tt&Co and them telling you they won then you should have no issues. Bott & Co are a legit company, how else would they pay you if you do not provide you bank details. If you are unsure then ring them up and give the details.

    Enjoy you compo

Finally had confirmation of my payment today from our 26 hour delay in 2012:

    Total Amount: £1236.06

Less 27% Fixed Costs and Interest - £349.05

    Admin Fee: £42.08

    Disbursements: £80

    Total pay out: £695.12

Not too bad in the end, been a long wait but nearly over!
