    Glad it worked for you, didn't in Tyzaps case or my own...

    I would no longer advise doing this as the NEB of other countries have absolutely no jurisdiction in the UK, it will not harm your case, but could cause delays, my advice would be to issue the NBA, them fill out N1, all detailed in Vaubans guide...

  • We too were on the TCX 3229 Corfu to Glasgow flight on May 25th and have started the process for claiming. Flightstats does indeed show a delay of 192 minutes but thus far we've not been asked for anything, just filled out the online claim initiation. I am anticipating the same response of no, there was no delay over 3 hours!
    However, we successfully pursued Jet2 for compensation for a flight delay last May with Botts but this time I think I will go it alone and see how it goes. Quite happy to issue the LBA, I'd be surprised if they caved on the basis of a couple of emails!
    The day we arrived at Corfu airport to fly back, I had already checked flight departures from Glasgow and knew that there was a delay in the outbound flight - however, I didn't anticipate being the person telling the Thomas Cook rep at the airport that her incoming flight was still on the tarmac at Glasgow.........don't think she took it very well! :rotfl:

    I'll keep you posted on the progress of my claim here if you can do the same. Fingers crossed we make some progress!

    The Thomas Cook staff didn't have a clue - the Greek girl at check-in could tell us more. The Thomas Cook staff didn't even seem to know what to do about giving us a refreshment voucher or anything.

    I just can't believe they are in denial about the length of the delay!

    Had some great help on this forum though so I'll keep going.
  • Received £900 offer (includes extra parking charge refund) yesterday, just over 3 weeks from lodging complaint. 2 passengers, delayed flight for 24 hours. Should have flown 945pm 19/05/15 Sharm to Manchester. Flew out 930pm 20/05/15. TCX2565. 4100km Sharm to Manchester. Used the template on this site and had no issues.

    We travelled on a package holiday with Thomas Cook a couple of weeks ago, on the return (Zante – BHX) there was a delay of around 8 hours.


    The flight out was with Thomas Cook airlines and the return one should have been too, however when we got to the airport we were advised that Titan would be operating the flight instead.

    My query is do I claim against Thomas Cook (package holiday, they SHOULD have been operating the flight, plus they provided a letter confirming the flight delays etc) or do I claim against Titan?

    Depends on whether the Thomas Cook travel agency substituted the flight with Titan or whether TC Airlines wet leased the Titan aircraft. My suspicion is the latter - but you might need to write to both to establish the basis on which they flew you.

    First letter when we arrived at the airport referred to change of flight , due to operational circumstances, they had arranged for flight to be operated by Titan under same flight number. At this stage letter referred to flight leaving on time.

    Second letter advised flight operated by Titan on behalf of Thomas Cook delayed due to unforeseen circumstances - advised new departure time some 8 hours later.

    Third letter on Thomas Cook headed letter from operating officer of Thomas Cook stated on behalf of our airline and Thomas Cook group.....then went on to say there was an unexpected technical fault, knock on this delay caused crew to exceed legal hours required to operate a flight and replacement crew now operating the flight.

    Fourth letter again from Thomas Cook confirmed delayed due to a technical fault and confirmed timing delays.

    So, it looks like for some reason they decided to replace the Thomas Cook flight with a Titan aircraft - due to operational reasons - and then the Titan aircraft had issues.

    What is particularly interesting that a colleague was also returning the same day from Kos and they were considerably delayed too - as they were told their aircraft had been used for the Zante flight and they had to wait for a replacement aircraft (which was a Thomas Cook airline)

    Sorry for the lengthy responses, just in case any other aspects are relevant!

    I'm just on my 3rd claim which is my 2nd Thomas Cook claim (already been paid out 1x Virgin & 1x TC :D).

    So far they have made me an offer but I am pushing for the interest. They say I will not get the interest unless it went through the court, I have not started legal proceedings, but I have sent an NBA.

    I spoke yesterday on the phone and today got this email:

    "We believe that your intention to issue legal proceedings purely for the interest which then becomes payable under Section 69 of the County Courts Act 1984, is against the Overriding Objective of the Civil Procedure Rules. We have made you a reasonable offer to settle your claim at the pre-litigation stage thus there is no requirement for you to issue your claim at the Court.
    We reserve the right to raise this point in respect of costs and the interest claimed should you issue proceedings unnecessarily on this matter."


    I told him on the phone that they won't send someone all the way from Manchester to Northampton court just to defend £500 of interest, plus they will lose the court fee too, and I said that I am happy to proceed with court action. What's your view, are they calling my bluff? I'm not familiar with this section 69, have you come across it before?

    If you have not started any legal proceedings and you push this to court, the court will most likely look unfavourably upon you.
    Potential interest only becomes a legal possiblity, not certainty, once litigation has commenced.
