I started a Small Claims Action in Scotland late in 2014 for a delayed flight to Glasgow in September 2014. Prior to the calling date I was advised by the Court that Thomas Cook had failed to respond and I did not need to attend. I requested Decree and this was granted last month. I emailed T Cook two weeks ago and was pleasantly surprised to receive an offer this week from Weightmans for the full sum (at historical exchange rate) plus expenses and interest coming to almost £1100.
So after much delay with poor/slow/no communication by TC the final leg has been very quick.
I would encourage anyone who has been waiting a while to explore the court route and to follow the excellent guide and advice on here. Thanks to everyone who posts and to Vauban for the excellent guide0 -
My 7 hour delayed flight Dalyan to Birmingham took place in 2011 - I was refused compensation twice on exceptional circumstances grounds, (the last time a year ago) but decided to take another shot, and resent my emailed communication stating I still wished to claim. I received a response within days, asking for proof I'd been on the flight - e-tickets were emailed to them within seconds. A day or two later they confirmed I would be receiving £570 in vouchers, which I refused. I was asked to call customer services who immediately arranged for £570 to be paid by bacs into my account. It arrived a few days later. :beer:
Don't give up. All my communication apart from the very first and last which were telephone calls, were via email.0 -
I called 01733 224800 (once they had agreed to pay compensation via email) and used the telephone option of having just returned from a recent holiday (just to help you navigate the telephone options).
Spoke to the advisor and they immediately agreed to make the cash payment, no problems whatsoever.

Great news . Used Bott and Co . Have been on this one for a while now. Received notification today that Thomas Cook have accepted liability for the 9 hour delay Sanford Orlando - Glasgow International 30/07/2011 Flight no TCX927 and I will receive payment in up to 42 days. Bott and Co will not advise how much yet however my claim was for 5 persons.
UPDATE - Received £1545 via Bott and Co yesterday . If you were on this flight , get claiming.0 -
Hi all, have had Bott & Co dealing with my claim for some months now & seemed to be slowly moving along when i get an email from them yesterday stating "we have reviewed your case in more details & having cross referenced it against our database it has come to our attention that we have previously dealt with a claim on this flight & unfortunately it was unsuccessful."
I asked them the exact reasons why it was refused as i had previous information that Thomas Cook were blaiming a power spike at Gatwick Airport for the 27 hour delay but i had an email from Gatwick confirming that no power spike had occured & no other aircraft had been affected.
Cott & co replied with "unfortunately we had a court hearing for another claim for this same flight, which we lost as the district judge ruled that the power spike was extraordinary circumstances & permission to appeal was refused"
so where do i stand now?! is the fight over? i have relevant additional evidence that no power spike occured.
Is it worth taking on the case myself with this extra info or time to move on with my life and put the whole sorry affair behind me?

EDIT Kab quick off the mark, might be worth sending Bott your evidence, see if they think it changes matters...
TC must have provided evidence to the DJ, to substantiate the EC, Bott would not give up on a case if they thought that they had a good prospect of achieving a win for you and them.
If you believe that you have strong evidence that there was no EC, then you are perfectly entitled to follow Vaubans guide and DIY..
Personally I'd accept what they say, they do this for a living...
But, good luck if you start your own legal claim and let us know how you get on...

Ive only had those 2 emails as contact really, im happy to phone them if they can provide more information.
ive had email correspondance from Gatwick contractors confirming no spike occured and so on, im assuming that i could get full written report from them upon request.
i just feel this has been consuming my thoughts for nearly a year (the main reason i passed it on to Bott & Co) and not sure whether ive finally hit that wall or that the part of me that wants them to pay for their incompetence wins over! but if i have very little chance of winning then its time to get a life i suppose!0 -
I would 'phone them as the written information you have may prove to be as helpful to them as you.0

got the automated acknowledgment.
To my surprise on Saturday they have emailed a holiday voucher to the value of £580!
