    Looks like Thomson have also increased the amount of 'manufacturing defect' excuses judging by the latest monthly news update from Bott & Co.

    Thomson.
    We received almost 400 defences from Thomson yesterday, the vast majority of which are arguing that delays were caused by manufacturing defects with no further explanation. We disagree that this is a valid defence and will be looking to push these cases through the court system as quickly as possible.

    There is no way mechanical parts built to aviation standards would fail at the rate they are saying they have otherwise planes would be fall in out of the sky at an astronomical rate.
    They have procedures in place to inform manufacturers of any defects and recall or modify parts if needed to stop any more occurrences .
    Thomas Cook are stalling paying me out at the moment blaming a 'manufacturing defect' in the radar dish but it's only a matter of time till the courts see this as just a delaying tactic.

    Jon, the CAA have written to the airlines and told them that only the manufacturer recalling a certain type of plane for a defect is considered an EC.
    The rest is the latest try on. The airlines simply won't give up exhausting every single sentence of dubious meaning in the regulation.
    And that's why people become so determined to take it to the end.

    Hi, just a follow up on my case. I have today received £590 into my bank account from Thomas Cook. Needless to say I am very pleased. They originally sent an email voucher but I wanted cash. Not a problem only took a week or so to get this. Polite emails from Thomas Cook as well, we cannot complain about their handling of our claim. I was on a flight from Dalaman Turkey in Sept 2010, which was delayed overnight to Manchester. I didn't have flight number or booking ref just a date and visa on my passport. Thank you once again to MSE.

    In Brief: a 25 hour delay in Barbados with 5 hours being left on the plane with no real food or refreshments and no proper apology. No support for the disabled and elderly in our party. The CAA backed Thomas Cook and said that no compensation was payable.

    Over two and half years fighting, two visits to court and two stays, I have now been paid out £7124 including 4% interest, £910 court fees, £76 costs. This is for a party of 13. Thanks for everyone’s help and advice on here, it pays to fight on and don’t back down.

    Our actions not only rightly compensates us for a terrible service and the many marred holidays we all get, it helps to make sure these planes become safer and more reliable and insures we don’t have our well earned breaks ruined. Through all my research it is unbelievable the seriousness of some of these faults on planes and how we don’t hear of more and more drastic accidents happening, hopefully they will now start to invest in their planes. The new Director of Thomas Cook has already said he intends to buy new more modern planes and that is down to people like us persevering.

    Obliviously a lot of unnecessary stress caused between the start and finish of my case and Wightmans did not do Thomas Cooks customer service any favours. This payment is a drop in the ocean compared to what they have lost in the past few years from us, never mind future years of avoiding booking with them again as a regular large holiday group.

    Thanks again to all the advice off this site and to everyone who has shared their experiences.:beer:

    Well done Sging1, your further point in that what the airlines just don''t seem to be able to grasp is very true, the lost business from previously satisfied customers is a very high obstacle to overcome.

    Our claim has been settled which has been on-going since 2012. Waiting for confirmation from Bott and Co as to what we'll actually get. I have a bad feeling it is going to be less than I thought, 1200 Euros was the compensation owed minus the fees, but they seem to be adding random disembursment fees and VAT on top.

    That's the biggest payout I've heard of!

    It was an unnecessary long rough ride but you just have to keep digging away. You can see how many times I put it back into the courts by how much I spent on court fees, £910 which I think related to four fees.

    Just for everyone to know, I also got paid based on the historical exchange rate of 2011.
  • After almost 3 years I have been offered vouchers as compensation from Thomas Cooke for a 6 hour delay from Mexico in 2012. I also claimed for new flights I had to purchase as we missed our connecting flights. I have asked them for a cheque instead of vouchers but they have not answered me though I have emailed them back on numerous occasions since January 2015.
