My advice would be to take them to court, like you've said you'd do. What other options do you have?0

Hiya just wondering if anyone can give me any advice...
I applied to Thomas Cook for a delayed flight claim in Jaunary last year but was declined due to "exceptional circumstnaces". I reapplied in December 2014 because of the law change, but as of yet have heard nothing.
Ive spoken to them in person and via online chat lots of times chasing a resolution but seem to keep being fobbed off. At one point in January I was told on the phone I should have a response within 2 weeks, but 2 months later I still have nothing. Ive emailed them requesting an answer within 2 weeks or I will consider going to court *the 2 weeks is up tomorrow!*
Ive just spoken to a lady who says she has escalated our case so hopefully we will have an answer soon but wont be any clearer than that!
Any advice?
Ps flight was Gatwick - Cancun (TCX412) on 10th October 2012 supposed to leave at 10am but 6 hour delay meant we left at 4pm.
1. Have you actually issued an NBA (rather than just "I will consider going to court").
If not, do it now!
2. If you have already issued an NBA, ring them to let them know "as a courtesy" that you will be starting proceedings next week. That's what we did, and they found they were able to give us an answer within two days.0 -

Well it's taken over 12 months since I threw in the towel and handed my claim over to Bott & Co after getting nowhere fast with Thomas Cook. Yesterday I received the email saying Thomas Cook have finally decided to settle on my 6hr + knock-on / reactionary delay from previous flights. Thanks to all for the support and advice given on this site - especially posts from Vauban & Novice Angel and of course to the trail blazers Huzar & Allen. I'd certainly have the confidence to go it alone in the future. Now to the difficult decision of what to spend it on.......

I did exactly this today - my NBA was issued two week ago today so thought I'd give them one last chance to see sense. More fool me!
Our flight - TCX 6525 Dalaman to Newcastle, June 2012 - was delayed over 3 hours so qualifies for compensation. So far TC have denied it on the grounds of (in order):
1) Extraordinary technical issue
2) ASU driving off whilst connected to the plane
3) Faulty air conditioning unit
4) Manufacturing defect on a replaced part
During the phone call I explained that Flighstats demonstrates the plane was never going to be on time as it had been significantly delayed 2 flights earlier - so knock-on. As well as quoting Wallentin, Huzar, etc at them.
After a 2 hour "investigation" they rang back to say they're still defending but now we're back to the "ASU driving off" excuse. :mad:
Despite them knowing they have no defence, they're willing to push this to court action, and incur more costs/time/effort for everyone. I can only assume they're hoping I'll give up - well dream on TC because the N1 form is completed and as soon as all 8 in my party have signed their declarations it's off to the Money Claims centre.0 -
