Hello All,
Just wondering if anyone else has a flight delay claim for the above flight,I'm now advised I need proof of booking and boarding,all I have is my bank statement detailing the amount paid to Thomas Cook.
Any thoughts or advice most welcome,the airline consider it odd that I didn't keep my boarding pass from almost three years ago !!

I contacted Thomas Cook using Martins template after our flight to Caribbean on 24/10/14 Tcx168 was 6 hours delayed. I got a reply saying the fault was a manufacturing defect so that that I couldnt claim even in light of new rules. I wasn't sure I believed this so did fill in a CAA claim but never heard anything back up to now
However today got an email out of blue from TC saying they have reviewed my case - didn't mention CAA - and that compensation is payable. They say I should have my payment in 28 days. Very happy. Thanks MSE0 -
I've been in an ongoing dispute with TC for the last couple of years for delayed flights on our honeymoon in 2009 (7.5hrs delay on the way out and 5.5 hours delay on the way home). They paid out for the homeward flight after approx a year of arguing but flatly refused to do anything about the outbound flight due to 'extraordinary circumstances' but then refused to tell me the reason for the delay. At the time, the CAA agreed with Thomas Cook so I decided to leave it. Following the Huzar case last year, the CAA told me I should get my case relooked at by Thomas Cook. I tried completing their online form and emailed their customer relations email address between Nov last year and Jan and received absolutely no reply. I called Customer Services on Monday night and after a 40 min phone call where I found out they had loads of details about my flights confused, he confirmed that compensation was payable and the £575 will be in my account in the next 10 days. For anyone still fighting with them, I urge you to keep going. Perseverance seems to pay off in the end! Massive thanks to MSE for all of the help with contacting them as well. xxx0

Just wanted to say a massive Thank You to everyone who takes time out to contribute to this thread and who's court cases etc have meant that i have now received full payment for both of my flight delay claims against Thomas Cook (luckily without the need for any legal action)

£590 in bank account this morning. I probably would have accepted TC's initial refusal of my claim (on grounds of "exceptional circumstances") had I not read all the excellent advice here. Thank you all very much and Good Luck to those still having to fight through the courts. I look forward to reading about your successes!!Many thanks
They are giving me cash (confirmed in writing and by phone) but are saying they are using rate on date claim admitted (last week). Using rate on day of flight would add further £50 or so. Not sure I am prepared to haggle further given it seems a bit unclear what rate should be used.

You can request cash but if the value of the voucher is better than the cash value, and you can use them, it is your choice.
I submitted a claim and there was no problem with Thomas cook admitting liability however, they did drag their heels with the payment.
I have just received £930 cash for 23 hour delay (Two people). There was no offer of vouchers.
Next is a claim against Swiss Air which is going through the courts. Not optimistic with this one though.

Hiya just wondering if anyone can give me any advice...
I applied to Thomas Cook for a delayed flight claim in Jaunary last year but was declined due to "exceptional circumstnaces". I reapplied in December 2014 because of the law change, but as of yet have heard nothing.
Ive spoken to them in person and via online chat lots of times chasing a resolution but seem to keep being fobbed off. At one point in January I was told on the phone I should have a response within 2 weeks, but 2 months later I still have nothing. Ive emailed them requesting an answer within 2 weeks or I will consider going to court *the 2 weeks is up tomorrow!*
Ive just spoken to a lady who says she has escalated our case so hopefully we will have an answer soon but wont be any clearer than that!
Any advice?
Ps flight was Gatwick - Cancun (TCX412) on 10th October 2012 supposed to leave at 10am but 6 hour delay meant we left at 4pm.0
