Hi,
I sent flight delay claim to Thomas Cook for 4 hour+ delay on a late night return flight from Rhodes to Glasgow on 26/06/13 (TCX 3105). Received a reply stating extraordinary circumstances due to unforseen mechanical error. I then submitted EU Complaint form to Greek Transport Ministry as advised on MSE, and received reply from them within 2 days!, advising they were submitting our claim to Thomas Cook and awaiting their actions or answers asap. That was 4th Feb 2015, but no contact received from TC yet. Anyone else in similar position?0 -
TC forging ahead as not taking the offer of mediation. Particulars of Claim comong together nicely but for one reference in the Defence to a Court of Appeal decision Graham & Anor v Thomas Cook EWCA Civ 1355 stating "the Claimants have no private law civil cause of action against the Defendant"
Any advice as to how to respond to this? Thanks

Just received £1920 from Thomas Cook after 5 letters, 4 rejections and two years of trying! We were delayed for 10 hours on a return flight from Tenerife to Newcastle in 2013.
Don't give up....keep trying...you'll win in the end!0 -

Hi All,
I've had some moderate success over the weekend. I first claimed in June last year and am conscious that my claim is due to expire in May this year (delay from Manchester to Dalaman 11th May 2009).
The claim should be for two adults @ 600 Euros - exchange rate of 0.89 on that date. They have written an email:
Please find enclosed a voucher to the value of £610 which you can use on your next holiday. This equates to 400E per person as outlined in the regulation for flight TCX506K.
Now, the amount should be £1064. I have my court application ready to go tomorrow, and I'd claimed the 8% interest on there too, which gave a total of just over £1,600. It would cost me £115 to put the court application in. I'm also thinking they've mixed up my application because my flight number was 5060 and as it's to Turkey, it should be 600E per person?
What's the general advice here please. Should I accept, go for the 1064, go for the full 1,600 or just put the application to court in?

Go back to them and have a discussion with them about the amount you believe your entitled to, you also don't have to accept a voucher, you can insist on cash, it's free to submit an NBA, but I'd give them a call first.

The NBA is what you sent previously.
And Dalaman to Manchester is just over 3000km - so it's not 600 euros each, it's 400.

Thanks for that, I thought it was 600 each, but I planned on another holiday anyway so I don't think I'm going to fight the cash/voucher thing.
So, I guess my story is a success story!
Complaint launched June 2014, had to wait for the case to be sorted, NBA issued 23rd December, payment voucher received 4th March for £6100 -
Thomas Cook have just offered me £610 off my next holiday with them for a six hour delay in 2011 they admit was their fault. My question is, do I have to accept the voucher or am I actually entitled to ask for cash? Thanks and apologies if this question has already been answered0
