  • Thomas Cook have just offered me £610 off my next holiday with them for a six hour delay in 2011 they admit was their fault. My question is, do I have to accept the voucher or am I actually entitled to ask for cash? Thanks and apologies if this question has already been answered

It is cash, unless you want vouchers:

    EC261/2004 states:
The compensation referred to in paragraph 1 shall be

paid in cash, by electronic bank transfer, bank orders or bank

cheques or, with the signed agreement of the passenger, in

    travel vouchers and/or other services.

I need receipts for the costs I paid to bring my claim, looking through emails from Salford Claim Centre I dont seem to have any from them. Can they send me copy receipts do you think via email?

Yes, or use your credit/debit card statement, MCOL only started emailing receipts this year I believe.

Have been told payment has been processed. Sorry if this has been asked before (and I did look at Vauban's brilliant guide first) but what exchange rate should they use: date of flight or date TC agreed compensation? Thanks again to everyone for all your help.

I was also on this flight and got same response from TC customer relations. Emailed again yesterday and said in light of Condor ruling I wanted another review. Gave them 14 days before considering legal proceedings.

Amazingly, today, I got their standard "we have reconsidered" email, saying I would be paid within 28 days. I am not counting my chickens, however, until the money is in the bank!

(Tireless and Oxfordmark, I PM'd you yesterday about this. Have you had similar result?)

They can pay you in Euros or most probably pay you at today's exchange rate. They might even try and give you vouchers.. I would insist on cash!

Whatever they want on an out of Court settlement.

    Many thanks

They are giving me cash (confirmed in writing and by phone) but are saying they are using rate on date claim admitted (last week). Using rate on day of flight would add further £50 or so. Not sure I am prepared to haggle further given it seems a bit unclear what rate should be used.

For me it's not unclear, the regulations are quite clear the compensation is payable in the Euro, and I've read a few posts of the airlines offering to pay in Euros.

However I undertand your point though, in my case if the airline were to use today's rate I would be over £100 worse off than back then when my flight was actually delayed, because of the monetary exchange rate. Personally I can't see any mileage in going to Court with that argument or to specifically ask for interest..

    Cheers,

  • Hello All,
Just wondering if anyone else has a flight delay claim for the above flight,I'm now advised I need proof of booking and boarding, all I have is my bank statement detailing the amount paid to Thomas Cook.
Any thoughts or advice most welcome, the airline consider it odd that I didn't keep my boarding pass from almost three years ago !!
