Unfortunately not JP just says forthwith. And the usual claptrap about paying within the first month to avoid being placed on the Register of Judgements.

My feelings are it should be settled quickly as the longer they leave it the more interest I'm losing as well.

    Thanks

I was also on this flight and got same response from TC customer relations. Emailed again yesterday and said in light of Condor ruling I wanted another review. Gave them 14 days before considering legal proceedings.

Amazingly, today, I got their standard "we have reconsidered" email, saying I would be paid within 28 days. I am not counting my chickens, however, until the money is in the bank!

(Tireless and Oxfordmark, I PM'd you yesterday about this. Have you had similar result?)

I was on this flight too, just heard back from Thomas Cook, no case for claim. I am writing back informing them that i do not accept this and can they review it.

Today at last I have received my Judgement for Claimant form. I have received compensation for the two of us through MCOL (I found out later in the proceedings that MCOL was meant to be for one). The judge has given me the historical exchange rate which I claimed for, MCOL fee and 8% interest.

It orders TC pay me forthwith. Should I now sit back and wait for there response? Or get right on the phone and make them aware of it?

I won't count all my chickens just yet until I can touch the money. But a huge thanks to all the posters on here who's experiences have helped me along on this 2 year journey.

    Well Chuffed :j

My God, just picked up an answerphone message from Weightmans. Stating they believe the judgement has been entered in error!!!! Can you believe this.... They didn't bother to respond anytime in the last 4 months... They said I will now need to wait to hear back from the court. Good grief, I had an 18hr delay due to a faulty pump written in black and white.:mad:

Thoroughly disgraceful and unprofessional behaviour by Weightmans.

  • our Thomas Cook flight was delayed in January for 24hrs due to a passenger on the previous flight becoming ill and the flight had to be diverted and then the crew were over their hours to then travel to Mexico to take us home to the UK we have been told this is extraordinary circumstances and therefore we cannot claim any compensation,"An operating air carrier shall not be obliged to pay compensation in accordance with Article 7" does anyone know if this is true and should we pursue the claim
    thanks

I hope you don't mind me saying, I hope not. Another stay would make me truly lose the will to live. Today started a great day and has now ended in tears. I thought the Van Der Lans case had nothing to do with UK law and therefore not a viable reason for stay..

Jackie read my last posts on the Allen thread, you can and should appeal IMHO, but there's no indication that your case has been stayed due to Van Der Lans.

Give Weightmans a call, first thing tomorrow and ask them what their position is.
