Recently got a claim declined due to "manufacturing defect", so unless they have a change of heart (unlikely) I think this one's going to court. Despite my trepidation, I actually hope it eventually gets into court - because this is the third different reason they've given for not paying out. Yes recently had the same manufacturing defect line, but this was dropped for a technical fault in TC's actual Defence...0 -
Have been pursuing a claim with Thos Cook since Sept. Finally got and E mail in January saying claim was successful and to expect payment within 28days. Finally received it yesterday 7 weeks later,

Please find enclosed a voucher to the value of £900.00 which you can use on your next holiday. This equates to €300 per person as outlined in the Regulation for flight TCX43K on 6th February 2009.
The on-time performance of your flight is as important to us as it is to you, and I’m really sorry that you were delayed. We look forward to welcoming you back soon.
So that is Vouchers...not cash. The wrong amount. It should be €600 each x 4 persons. ( long haul and over 4 hours late)
So yet another delaying tactic, while vouchers are returned and amount disputed.
Why can they just not pay up without this constant battle, it's very disheartening. I suppose that is their tactic..,hope you will give up0 -

you are now in a sticky position if you did not commence court proceedings before the 6 year anniversary of your flight. Whilst I agree that you should have cash not vouchers, If they come back and say the flight landed between 3 and 4 hours late so the €300 is correct you will not be able to go to court.

What TC have done with you, and others too, is against the regulations, even Simon Calder highlighted this on TV recently.
The airline can offer you vouchers in place of cash but you would need to accept them first.
If they send you vouchers against your will you should vent your frustration and also report them to the CAA.

Today at last I have received my Judgement for Claimant form. I have received compensation for the two of us through MCOL (I found out later in the proceedings that MCOL was meant to be for one). The judge has given me the historical exchange rate which I claimed for, MCOL fee and 8% interest.
It orders TC pay me forthwith. Should I now sit back and wait for there response? Or get right on the phone and make them aware of it?
I won't count all my chickens just yet until I can touch the money. But a huge thanks to all the posters on here who's experiences have helped me along on this 2 year journey.

Was there actually a hearing with TC in attendance? If not remember they can still apply for setaside, but lets hope not.

No hearing JP. They did not respond to a final 28 day order to provide a credible defence to the DJ after I asked for the stay to be lifted. Therefore they were struck out.

Well, just phoned TC as was told just to wait. Legal are no longer in there building and when my Order gets to the top of the back log they will get in touch. AAArgh the saga continues..... Damn you TC hehehe0
