    So many holes in TC evidence docs, self incriminating most of it even witness statements, don't think they are even trying too much.
    Expecting more from them, I was expecting something big and leaglease from them but no, bit of a let down concidering how much effort they are puttting in. Some stuff very outdated since Huzar, are well we will see if the judge wants this to go on.
    They said one thing originally, then hey they agreed now with my evidence so why go on?

    Compensation received for TCX 6402 - 15/06/2013 - Newcastle to Ibiza.

    Like a lot of recent posts I had to chase TC by phone after being promised payment within 28 days. 15 days after the due date, I've received £900 (1200 euros). So big thanks to everyone on this guide for the advice! :beer:

    Just sent an NBA for a claim on flight TCX 6525 - 24/06/2013 - Dalaman to Newcastle.

    Recently got a claim declined due to "manufacturing defect", so unless they have a change of heart (unlikely) I think this one's going to court. Despite my trepidation, I actually hope it eventually gets into court - because this is the third different reason they've given for not paying out. Would love to hear TC explain that to a judge! :rotfl:

    Exactly right CM - they just take the mickey and assume we are all daft. Well thanks to the interweb and sites like this, the balance of power has changed! Take them to the cleaners, the dirty scoundrels!

    Date: 22 June 2008 Faro to Manchester

    I started my claim for an 8 hour delay in June 2013 for the above flight using the template letter from this site.
    TC defended the claim on the grounds of EC. After contacting the CAA
    & finding they couldn't help I sent off the forms to the NEB in Portugal, which I've found out was a waste of space. Since then it's been a game of email tennis.
    Just before Christmas I was offered vouchers to the value of £1312.
    As the claim was outside the 6 year limitations & I couldn't legally take them to court I thought I should accept the offer. At least I'd have something to show for wasting their time & mine :mad:
    I couldn't resist - sent an email back asking for the cash what the hell.
    TC confirmed this was acceptable & £1312 was deposited yesterday :j
    I'm now checking out holidays for this year.
    Thank you to all who have helped me in the past , just got a claim for Monarch to win now & I'll be done until the next delay

    Well done for giving it a try, although, I doubt if they realised it was over 6 years.

    Hello All
    I have been reading this forum all day and there is nothing on this site regarding my concern and the flight mentioned above. My flight from Enfidha-Tunisia was due to take off 21.50 but was delayed by 2 hours, now this is where it starts to become confusing. Due to low fog at Gatwick we were circling the runway along with other planes, we then came out of the queue and flew to Stansted for the aircraft to re-fuel, we were not allowed to disembark. The plane then took off again to land at Gatwick by this time it was 4.45am. The airport had been kept open especially for this flight, the passengers of this flight were the only ones in the airport at this time. (We should have arrived at 0.55).
    When I initially wrote an email to Thomas Cook on 9 July 2014, I was unaware that the flight had to be more than 3 hours late landing in the UK and was not really sure I would be entitled to anything, I received a response from them on 8 August 2014 saying that my flight was only delayed by 1 hour 46 minutes. I thought nothing of it and did not persue further.
    However on 21/11/14 TC sent me an email saying they were reinvestigating my claim as they were waiting for Huzar vs Jet2 case to be heard.
    Today (4/3/15) they have sent me another email saying that my case is now closed as my flight was only delayed by 1hr 46 mins.
    I have checked flightstats and it is showing unknown for the status.
    Based on what I have written would it be worth me persuing compensation as I know that weather conditions are not usually accepted.
    Any help or advice would be appreciated.


    Also the email they sent today had a landline number 01733 224 814 hope this helps some of you.

    Thomas cook flight. Hi im looking for some advise please.We flew from Manchester to Cuba on 22 sept 2010. Our flight was delayed about 45 mins. Then we flew as far as the Irish sea then turned bk because of a technical fault (broken lightbulb we were told) were taken off this plane then boarded again. Around 4 hours delayed all in. Flight stats say our plane was cancelled.are we still able to claim? Many thanks

    zs21 - you state that your flight was due to arrive at 00:55 at Gatwick, yet you didn't land until 04:45. Clearly that is a delay of more than 3 hours.
    Yet what was your reason for the original 2 hour delay in departure? This could be cruicial to your claim validity.
    Was the low fog an issue for other flights at the time you were due to land at 00:55?
    That fact that you had to refuel, is within the airlines control, since they chose not to carry extra fuel for such contingencies.
