TC have requested a whole bunch of cases stayed at liverpool, how can I object as this is bundle combind. If they cases are stayed-
Do I still send my docs by the required date?
Pay the hearing fee?

If you know they are applying for a stay in your case and you don't think a stay is valid in your case I would write to the course requesting the hearing be held as there insufficient grounds for a stay. Is your hearing due after the 25th Feb case?If you're new. read The FAQ and Vauban's Guide

Hi Batman, although it's obvious that you want the stay lifted, it might not be such a bad thing that it's gone to Liverpool where the Judges have developed a strong truer understanding of the regs..
......and you might just find that if the Allen case, goes our way, as I think it should, then you might find the stay is not granted and you're all ready to go.
I do agree with JP though, put in your stay objection to the Court.

Already put my objections in to both courts, TC had a long list of cases they want stayed including Bott&Co cases and other solicitors and LIP's. I suspect our friends Bott & Co are already fired in objections and others, cheecky though not informing my court judge about it. Thing is do i still need to follow court orders and submit my docs in a couple of weeks and pay the fee? If i do that means if they are stayed the defence will have months with my claims and evidence.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Well just because TC have applied for the stay, does not mean the full directions of any Court order should NOT be followed...
The reason I say that, is that in a debt recovery case, the naughty person that ows the money ( forgotten the posh word ) may apply to the Court for a set aside, but until that is granted, the Sherrifs have to continue the debt recovery process ~ Watched it on telly!
Tbs, PtLV might be able to give a more structured reply than 'Watched it on telly!' However, I do think you need to follow the Court directions as they stand and IF you get a hearing before Liverpool TC's stay request then that's all good. Afterall you can't stay a Court case that has already been given a judgement.

Yeh will follow directions of the court until being told different, my hearing in in April. Annoying as TC just don't get it after Huzar they told the court when they applied for stays on Huzar that it would bring clarity, now they say the same again!
