  • Does anyone know of a name and address where I can complain about the obstructive behaviour of Thomas Cook Customer Relations. My flight from Gran Canaria to Manchester on the 22nd Sept 2014 was delayed by 6 hours. They claim adverse weather despite it being fine in both places.They refuse to give me any details re the location of the alleged adverse weather. They insist it is the CAA that I should send my claim even though I pointed out that the flight was from a Spanish airport. The CAA say I must contact their Spanish counterparts. They have so far ignored my request for an address where I can complain about their obstructive behaviour.

    You can write to the AESA, I personally found them very helpful but to put it bluntly even if they find in your favour they have no legal powers to help you.

    In fact, I've read stories of even judges not even interested in reading their findings....

    Your only redress is Court I'm afraid, read Vaubans guide then come back and ask any questions that you have.

    TC have 7 days remaining to respond to both the court and myself. Failing this I will be appying for a judgement. Could anyone give any advice on this?

    Is there any terminology that should be used? And should I include the amounts claimed for, adding the exchange rate at the time (as per there defence) and the 8% (£0.15 interest).

    I bet they won't let it get to being struck out and come up with another poor excuse at the 11th hour. But better get prepared just in case.

    Any help would be greatly appreciated.

    Judgement by default ?

    It's simply a tick box form, N225 hmctsformfinder.justice.gov.uk/courtfinder/forms/n225-eng.pdf

    Just a word of warning, some airlines wait until the very last day before filing a defence, please don't get your hopes up!

  • Hi guys,

    Wondering if someone could help.

    I applied for flight delay compensation from Thomas Cook as we were delayed 9 hours at Manchester airport back in October.

    I used the template from this site to which they responded with a very generic letter which states the reason for the delay was weather and they are not liable to pay any compensation.

    I have since responded and asked them for further details of the weather conditions that caused our delay as on the day in question the weather seemed to be fine in Manchester and fine in our destination (Gran Canaria).

    They responded with the same generic letter stating that the weather was the cause of our delay.

    Are they obliged to give further information regarding the weather conditions or is this the end of the road for me? Is there any other action I can take on this as I don't feel that Thomas Cook are giving the full story.

    We were told on the day that a plane had been taken out of service within the fleet and this led to us not being able to fly on time

    Any help is appreciated

    I was also on this flight!!! had the same !!!!!! response and trying to figure out what the next step is

    Start by reading Vaubans guide and check the historical weather data for that day, check flight stats, see how many other aircraft were delayed due to the weather.

    The only way you'll find out if your delay was caused by the weather is in the airlines Court defence.

    Visibility 10.6 kilometers

    Does anyone know what constitutes bad weather? the wind speed was a maximum of 26k/mh which doesn't sound at all bad to me

    I think I have a case for compensation? Is it worth me taking out legal proceedings?
  • It took me eight months, innumerable emails between TC and me, several to the court and the CAA was worse than useless BUT TC settled in full.
