It's really up to you, but if you give them more time they will certainly take it.
They have had almost three months to sort things out so far, and will not hurry if you allow them even longer. Your complaint will probably just go to the bottom of the pile.
If you decide not to keep waiting read Vaubans superb guide and issue a NBA (notice before action) asap. That should get things moving.

You need to reply with a time limitation. Looks as though you have already waited 3 weeks from the date of their letter. Note they haven't even had the coutesy to give you a time frame at all, or ANY indication of how long you will have to wait. Appaling cutomer service.
IMHO? Send an NBA giving them 2 weeks for a response with a definitve answer or you will commence legal proceedings.If you're new. read The FAQ and Vauban's Guide

Thanks guys, will get an NBA sorted, can I ask advice on =Im not the lead passenger should I get some sort of letter of authority from the lead bookers name(our party was 4 adults and my 2 children)
I have looked at the MCOL its a bit of a minefield but guessing some one has done a template or step by step guide on how to proceed...0 -

I would just agree with send the NBA, it shows from their side, that your getting advice from others, and that you are serious.....

I'd try giving them a call first, i did this and had an email within an hour confirming they would pay up in full!0 -
Hi all, hope can help.
We had a 7.5hr delay returning back from Ibiza on 4th June last year TCX5003. Our friends (a couple) were successful with their claim receiving back £641. We however were unlucky as a group booking of 9. We were first told we would receive a voucher for £2934, only to receive an email 5 days later saying we had been denied.
Several angry phone calls & emails later got nothing back but they couldn't answer why our friends had been paid out, blanked the question.
So I had to write to the Spanish National Enforement Body (AESA) as the delay was from a Spanish airport & they wrote back, acting in our favour.
Thomas Cook have now changed their minds & I received an email yesterday offering us a voucher for £1860 (part result). The reason for the reduced amount is due to 3 of the party of 9 were a free child place and didn't pay anything for there trip
A few questions to you good people are:
Does anyone know if a free child place is not entitled to compensation? (I have read on Bott&Co website that you can only claim for infants if you paid a small part / all for their ticket even if they didn't even have their own seat).
Even though we are happy to finally receive something after 7 months hard work, we do not know why we are receiving slightly less per adult than our friends, should we ask for the adjusted amount to match our friends est. £1923? Or are we being greedy
With all the hastle TC have caused us trying to claim the compensation (phone calls, emails, sending recorded mail abroad etc.) we are very reluctant to book with TC again, so should we ask for the cash equivalent?

You cannot claim delay compensation for a FREE child place.
The compensation due under EC261/2004 is a fixed amount which varies on several factors, read Vaubans guide for an explanation.
You DO NOT have to accept vouchers as compensation you can ask for cash..
As for being greedy, it's up to you, if you want to claim, only you know how the delay affected your family and holiday.

i was on this flight with my family, my sister called TC from the uk when we were in iceland and was told the reason the plane could not land in st john's was because it did not have enough power to fly into the gulf stream so it needed to turn around so the gulf stream was behind it to power it to a safe landing. we saw engineers on board when we got on the flight and we were told 'slight problems, nothing to worry about' in my opinion, if there is any doubt, the plane should not take off. the pilot made a bad error of judgement,did he not hear the bangs on take off? yes i am glad we all landed safley, and credit to the crew for that, but we should never have taken off in the first place. our holiday was never the same after. unless you are in that situation you do not know how frightening it is.
received a letter of TC. we are not entitled to a penny compensation. they are siting extraordinary circumstances. is this true0
