Sorry NoviceAngel, I should have made it clear. My case was stayed as many others pending Huzar. Since then they and Weightmans have refused to answer any correspondence or even make contact. Upon requesting my stay being lifted the judge saw no reason for them to defend the case any further and gave them 28 days to respond with credible reasons or be struck out. So neither Default or Admittance!

When their time is up, I would write to the Court Manager, noting that the defendants have not responded in line with the Judge's order and asking that the matter be put before the judge. S/he may then even give you a judgement, or formally strike out the defence and invite you to apply for default judgement (on the N225 form).0 -

Thanks Vauban, I was unsure whether to apply for the Judgement through MCOL or the Court. But I guess now that the court process has started it has moved beyond the realm of MCOL.
Thomas Cook are so infuriating :mad:..... They pay some people without any hassle and quickly. Some they push to the front doors of the Courtroom and others like me left in the dark after a 2 year slog.
What a way to run an international company:(:(

Okay - still check with the Court though that they haven't received anything before you apply for judgement.0 -

I hope someone might be able to assist me.
Clearly flight compensation can be a complex area to determine what can be claimed and what can't.
I flew Thomas Cook from London to Cuba. My return flight was delayed for nearly 27 hours. I don't know the exact cause of the delay but do have some details. The flight was en route to Cuba (hence this would be the plane we returned to London on) but was turned back to London due to some kind of technical issue with the plane. No replacement flight was available so we had to wait until the following day to return home.
Based on this information do you feel I am entitled to claim compensation or is this an extra-ordinary circumstance that is outside the scope.
Advice would be appreciated.

Hi, I'm wondering if anyone can help. I was delayed over 3 hours in a flight in 2009, I have checked online that the flight was delayed. Other flights were taking off in the meantime, it was something to do with the plane, they had to send a replacement.
My problem is I don't have my booking documents or references. I booked through the co-op travel agent in Coventry which now no longer exists. I have phoned the co-op and they have since changed their systems and no longer have access to things from 2009. The holiday was a Thomas Cook holiday, I have phoned them and they have said they can't trave me or my boyfriend on their systems. They have said it may be on a 3rd party name if the holiday was sold through a travel agent. I am now co platelet lost as to where to go next, is this the end of the road for me? If anyone has any advice I would greatly appreciate it.0 -
