batman, have you received copies of all TC's documents yet? If not, maybe worth contacting them to remind tham that even if they get a stay, as a coutesy to you and the court, they still need to comply with the directions.
Perhaps you should revise your bundle? Include the minimal evidence you are relying on, and minimal/none arguements/reasoning? Save that for the hearing.If you're new. read The FAQ and Vauban's Guide

I would like to do that but the order says I must submit all documents I intend to rely on, no document will be concidered if it has not been submitted. Perhaps when they see what I have they may reconcider.

Ahhh, may have found something interesting... My order say in the last para, This order was made without a hearing, parties have the right to have this case/order varied or stayed within 7 days of this order and must do so in writing. Now then they are out of time! the order was made early Jan. They did not even write to my court!
It also states- 1st para, Warning you must comply with the terms imposed on you by this order befor the deadline expires, if you cannot comply you must notify the court by formal application before any deadline expires failure to comply will mean the case will be struck out or some other terms imposed. Yes. But the airlines do this all the time. Unfortunately, it doesn't seem to affect the outcome - and the judge still proceeds to assess the merits of the case. So stay focused on the salient points of your claim, is my advice.0

I agree, I read the other day I think it's in the 'how did it all start' thread, from Tyzap.
He was commenting on how unfair the Court system can be, and I'd expand on that, it seems among the many cases that I've dealt with ~ Not flight delay ~ that sometimes I'm astounded at the behaviour at the other party...
For example I had a case where Questions had been put to the respondent, the respondent had been ordered to answer them by a certain date, three weeks after that date, we were back in Court for further directions, I first of all informed the Court that the respondent had not complied with the Court order, the DJ turned to the respondents solicitor and actually said 'I'm sure that's just a genuine oversight on your part' 'Oh Yes' came the reply, Judge looked back at me and said, 'It's just an oversight'
It happens over and over again, you fill in N180, serve a copy on the respondent, the other party never actually sends you their copy. ohh don;t get me started on the inadequacies of the legal system :mad:
