    After a lot of slow balling I finally received an email back from TC saying I'm due compensation. One slight problem is that i got Botts involved last week, what should i do in this situation? I guess Botts sent a letter but as far as i can tell the email back from TC relates to the case i setup myself. Nothing to do with Botts i dont think.

    If you signed it over to Botts, then strictly you're committed. Perhaps give them a ring and see if they'll let you off. (If they haven't done anything with your claim yet perhaps they will.)

    Phone them - that's what I did when they ignored my request for "no vouchers" and sent me one anyway.
  • Just out of interest. Once compensation is agreed by bacs (TC have my bank details) how long have people been waiting for the payment to be made? And do you get an email from tc to confirm?

    Lets hope the judge that heard my case has fully understood the whole Huzar appeal since 2013 then....

    I also forgot to mention, the Judge dealing with all TC cases at manchester is District Judge Hovington, eemmm He's my judge!

    I flew to Cuba with Thomas Cook in November 2012 from Manchester and the flight left on time, but after flying for approx. 1 hour one of the engines broke down, we returned to Manchester airport and was told it would be 23 hrs before we would be flying again and we lost a full days holiday.
    They put us up in a hotel for the night., 6 week ago
    I put a claim in to Thomas Cook and was told we are not entitled as the original flight left on time, can they do this?

    Hi infodeals,

    This is of course a nonsense, read Vaubans guide it's all in there.

    The actual time of the delay is the time the flight landed at it's intended destination and the actual time the door is opened.

    Although to be fair, if the technical problem with the plane was an emergency it probably will be argued by TC that it's a genuine EC, search 'EC during flight' that might give you some posts to look through.

    .....and keep the SCs Huzar ruling in mind ;)

    But novice - the engine broke down - that's a technical, whether its an emergency or not. I hope its not that dodgy 767 with the right engine issues again.......
