Thomas Cook are refusing to even look at my claim because we dont have a boarding pass, invoice or the like......it's from 2009..... of course we don't have it. Ocean Village no longer trading so cant get anything from them !! anyone overcome this ?
They could also be stonewalling you knowing that legally you are running out of time.

29th September 2012 flight TCX2312 from Manchester airport to Alicante at 6.30am.
Arrived at airport to check in to be told there's an 'airport delay' till 9.30am.
Once boarded the plane (my first time flying with my husband and 3 children) we took off and realised something was not right. We got told that the pilot could smell oil/fuel so he had an oxygen mask on we had to turn round and have an emergency landing. Once landed we was not allowed of the plane while checks was done. 30 mins later we had to leave the aircraft and taken back to the terminal. There we was given £8 meal vouchers each.
We was then told that we will be boarding another plane at 2.30pm.
We arrived in Benidorm 7 hours and 19 mins late it was there I got told I can claim compensation for flight delay.
When I got home I looked into it and I had saved all the holiday paperwork and boarding passes etc.
I wrote to Thomas Cook, they replyed with the standard letter what everyone else got then a few weeks later I got another letter to say that we not entitled to any compensation as it was an extraordinary circumstances.
I then wrote back using a template from this site again I got the same excuse.
I heard about the court hearing last summer about jet2.
I thought on the off chance I would write to them again. Thought I didn't have my paperwork anymore but lucky for me it was saved in my 'sent' email box as I sent paperwork to the CAA.
Just before Christmas I got an email saying I am entitled to compensation and a voucher will be sent by email in the next 4 weeks.
Once I recived the voucher I gave them a call to ask for cash value. They agreed and today I have received payment in my bank.
The only problem I did have was that I have got married since the holiday so they asked for a copy of marriage certificate which I emailed to them along with bank details.
The holiday was for 7 people. 4 adults,2 children and one infant.
The total holiday cost £982 and I have received £1920 compensation.
I just want to say a big Thank You the admins on here and all the info you provided.
I hope every one on here gets what they deserve. I for one will not be flying or booking a holiday with Thomas Cook again.0 -

have received letter this morning from solicitors asking me to contact them to discuss matter without prejudice - any comments or advice please would be appreciated before i call. what does this mean - good news hopefully :-)0

After I have sent my documents to the court and then got the defendants documents in return, how do you then submit documents once you have gone through the defence they sent in response?
I have already gone through the first defence papers and countered them, now I may need to go through the defence bundle and counter argue.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Thank you Vauban for guidance - I was initially a little overwhelmed re. pursuing a claim and considered using a NWNF co. but used your guidance and have now received telephone confirmation that my claim will be paid for a delay on 13th June 2014 from Lanzarote to Cardiff- in cash for £640.00. Very happy0
