    That'll be a lovely surprise, I'm the same, I told my friend when the initial claim got rejected but I haven't told her I've resubmitted and been successful yet, she'll be over the moon.

    That sounds like a really epic struggle Topcat - many congratulations.

    Would be interested to hear more detail: did the airline ake formal submissions to the court that proved factually untrue? And was there any criticism from the judge about this?

    In my case - which also took three hearings - Monarch submitted to witness statements which their witnesses had to retract because they couldn't substantiate the contents and were not prepared to attest to them on oath. Frankly it's a disgraceful cavalier attitude.

    As I have a reference/case number I cannot be timed out (hopefully) as that will evidence submission.

    How long (ish) is it taking them to respond to claims ?

    No Carpediem, if you go 6 years beyond the date of the travel delay before your submit COURT papers (N1 or MCOL) you will run out of time. 5 years in Scotland.
    It matters not one jot when you contacted the airline.
    What date was your delayed flight?

  • I have been waiting months for a reply from TC about being delayed 24 hours in Florida in 2011 and received one yesterday.

    At the airport I was told someone had been in an accident and our plane was diverted to them, in the email it says it was due to a component failure but because it was a manufacturing problem they don't have to pay out.

    Also, the lady continually referred to my 'previous claim' and 'reassessment of the previous outcome' despite not having any contact with them prior to yesterday.

    Has anyone else had a similar reply?

    Load of bo**ocks - they are wasting your time and they should be taken to court.

    Seems like an awful lot of manufacturing faults on parts they are fitting. More like the latest bull excuse that their legal team have come up with.

    I have just received a letter detailing my compensation of £720. I have no argument with the amount being offered. However, They have said I am to receive it in vouchers towards my next Thomas Cook Holiday.


    Are they allowed to do this is or can I make them pay in cash as I would prefer. ?
