  • Hi all, just looking for some advice on whether I can claim for a 24hr delay.
    I got delayed in Gran canaria, because of the ash cloud incident back in 2010. I canceled my original flight with Monarch which was grounded, and rebooked new flights with Thomas Cook for Thusday 22nd April. I arrived at the airport and queued up along with the other passengers, but noticed some being asked to stand aside. When the rep with the clip board finally reached me, he asked my name and I was then told to stand aside with some other passengers. He then told me this was a repatriation flight and we would be put in a hotel until another flight became available. After a lot of arguing and refusal, I was finally threatened with airport security, so moved aside.
    Our flight took off the following evening, on a Jet2 plane which then landed in Leeds Bradford, but my flight should have been to Manchester. When we landed there was no bus organised to take us all back to Manchester, so we had to wait for 2 hours out side the airport. What I would like to know is could the airline use the knock on effect.

    Thanks for the info. But no point taking TC to Court at present time due to Appeal pending and no point if i cannot see the nature of the technical issue with the plane and make a judgement call on this!
    Any ideas or should i 'force' the claim a little and go the Small claims route anyway ie worst case is a stay from the Court....

    That's your call sweety. Personally, I would simply put my claim in and see what happens - there are a minority who still get paid out, as Thomson's not seem always to defend. The worst that can reasonably happen is that it gets stayed. If you flight is approaching either six years or two, you should definitely put in the claim now.

    Delay was July 2014 with Thomas Cook and for over 26 hours! TC quoting the usual 'technical issues' cause and i have requested them to explain these in more detail, but theyre not going to are they?

    Do i need to notify CAA just to follow all usual avenues and then send TC a NTB and go via Small Claims Court, as the delay shortened our holiday in resort considerably too?!

    Unbelievable!!!

    NBA seems to be the way forward......the claim is based on the EU regulation fixed amounts PLUS loss of over a days worth of 5* all inclusive resort time plus stress and disappointment for 2 small kids and 2 adults and TC even gave us a letter in resort to give to our insurers!!! admitting the delay. I cannot see how, regardless of the EU 261 part of the claim, TC can expect to contest our 'losses' ....why the delay? Can the Court defer the EU 261 part of the claim and proceed with the other parts ?

    After contacting TC through their website 'EU regulation complaints' and sending a detailed account of our 13 hour delay I was offered a £982 voucher to use with them. I immediately phoned the customer service department informing them I had no intention of using TC again. On the same call, after giving my bank details; the call handler told me the £982 ( 400 euro for each of the three of us travelling) would be deposited into my account within 14 days. I have now had an email confirming that it has been authorised and processed and will be in within 10 days.
    Not got it yet but seems promising.

    Do I tell the missus when it arrives? or should it pay for next years golf subscription. :0)
