has anyone put a claim in for flight tcx5625 dalaman to east midlands october 29 /2011 flight was delayed for 24 hrs but can,t get new flight number, plus original letter from thomas cook admits flight was delyed but has wrong dates on it

A bit advice from the experienced guys required.
Delayed on flight TCX473 on 12/10/12 travelling from Sandford to Manchester. The plane we flew on OY-VKF had just completed 5 long haul flights; LGW - SFB, VRA-LGW, LGW-VRA, Cun-LGW & LGW - CUN with turnaround time of approx. 2 hours on all. However prior to the LGW - Cun on 10/10/12 it experienced a delay on the ground as it was almost 9 hours late on departure.
As usual Thomas Cook have quoted Technical Problems due to Extraordinary Circumstances.
Have looked closely at Finnair Judgement 2012, when it was clarified that "extraordinary circumstances" may relate only to " a particular aircraft on a particular day" . This decision involved a flight which was initially cancelled rather than just delayed and then the knock on effect for the passengers on the later flights.
Can that decision also be applied in the circumstances I have explained as the issue with the plane was on 10/10/12 (over 48 hours earlier) not 12/10/12 when I flew on it?
Is it worth highlighting all this to Thomas Cook or should I just proceed to Small Claims Court?

Finnair is a bit of odd one as the wording is very precise in the judgement. It my apply. Lord Vauban is probably the one to give the most "learned" response.
However, subject to Huzar outcome, it is to some extent irrelevant as tech issues should not result in an EC get out. Especially on a previous flight.If you're new. read The FAQ and Vauban's Guide
