IMO give TC one last chance by quoting relevant laws then await Huzar progress. Seems little point in proceeding with Court claim at the moment whilst the vast majority of claims are in limbo.0 -

I am using the small claims court and have a court date set for 3rd October. I have not posted since July, as i have not heard much more since the court date arrived. This morning I recieved a letter from the court with a copy of a witness statement that Thomas cook have submitted from their "engineer manager". Basically it just states that the plane has a technical fault and thomas cook would not fly passengers on an aircraft un fit for flying for health and safety reason blah blah blah and he signed it.
is this another scaring tactic from thomas cook? also, will i recieve anything from the claims court to point me in the right direction of setting up my court defence or do they not do that? its only a month away so thought i might have recieved something by now.
I am starting to think my case is going to be stayed anyway due to the huzar case and reading comments from others in here.

ok I have just found Vaubans's very helpful example of things for my court bundle so will use that as a guide. i did not realise I need to submit these to the court before the hearing. can I do this by post or email? I have had no information from the court about submitting such items and obviously this is my first time at doing anything like this. i thought the court might have helped point people in the right direction but it appears not. thank goodness for all the helpful posts on here.0

Good luck. You should check the document with the "Order" from the Court about the hearing date. Is there nothing in there about when to submit documents that you intend to rely on? If not, give the court a ring tomorrow and ask if the judge has made an order to do so, and if not when should the court have them by.

ive failed already. I am a classic example of a person who has no idea of what they are doing. I got so wrapped up in the letters about the judge ordering we should try to settle this in mediation before the court date that I failed to turn round one of the letters about mediation which then goes on to say about when all documents should be submitted for court. this was by the 29th august and I should also have paid the fee by the 29th august. Failure to pay the fee will result in the hearing being removed from the list.
Oh bloody hell *bangs head against wall* why did i think i could do thissuch a stupid idea. my only opportunity has been and gone and I failed at the first hurdle. well done me.

Not been on here for a while ,a month or so ago we got a letter from court saying our case was on hold pending the result of huzar appeal.which I gather is the norm.
Today we recieved a letter from wakefield county court (our nearest court).to say that as a result of an order made on the 1st sept our case has been transferred to Liverpool county court
Does anyone have any idea of the reason for this?0 -

Hi first on this forum in ages, sorry
Im after some advice.
Myself and the wife was on a flight from manchester to antalya in 2013 and thomas cook had chartered Pegasus Airlines, we turned up at the airport and was told about a hour delay due to a tech fault in antalya.
I know about the EU rule etc and I filled in the form via this site about 40 days ago and all ive had is emails saying we will investigate etc 28 days etc.
Ive tried ringing TC but when you press the number it just tells you to fill in the complaint form.
Any ideas or pointers.

How long were you delayed on arrival in Turkey? If it was less than three hours, you have no claim.0
