Flight delay and cancellation compensation, Thomas Cook ONLY

  • I was delayed 24 hours this week on flight TCX 3035 Larnaca to Glasgow. I emailed TC two days ago claiming €600 x 5 (passengers in my group) so I'll update everyone with how I get on! Reason for delay was pilot caught food poisoning on the flight over and TC couldn't get another pilot over to Cyprus until the next evening.
    Was anyone else on this flight?
  • Please help , in july we had a 15 hour delay from sharm to birmingham , initially the flight was supposed to be leaving at 9.30pm , it was delayed for a few hours then cancelled , we were moved at 3.30am to a hotel , told we had to check out by 8am to be taken back to the airport to fly at 12 , because of the 6 hour drive to get home from birmingham we were booked into a hotel , this was lost because of the delay , when i got home i contacted thomas cook wanting a full compensation for the delay , today i have had a reply ,

    Thank you for contacting us about your flight.

    I am sorry that your flight with us was delayed and for any inconvenience that this must have caused you. We work really hard to ensure that when a flight is delayed the disruption caused is kept to an absolute minimum.

    Unfortunately there are a number of factors that can contribute to a delay that have to be considered, such as Airport Authorities or Air Traffic Control, before an up to date departure time can be secured. As soon as confirmed information becomes available we commit to telling our customers at the airport or in resort. As an apology we would like you to accept a voucher to the value of £150.00. I’m really sorry for any disappointment caused as a result of the delay. This payment is in full and final settlement for everyone on your booking.

    The on-time performance of your flight is as important to us as it is to you, and I’m really sorry that you were delayed. Once again, thank you for contacting us, and we look forward to welcoming you to travel with us again soon.

    The delay was caused because of a customer on a previous flight had knocked internal covers off bearing wires and they had to fly somebody from cairo to check , this would mean the crew would be out of flying hours absolute rubbish , is it worth me taking the voucher or telling them no way as they are admitting its there fault .Regards Richie:

    Why are you posting this again (for a third time) when Alan has already answered your question?

    As Alan says, if there really was damage caused by a disruptive passenger on the incoming flight, you may struggle to get compensation. And you'll only know for sure (again, as Alan says) if you actually take the airline to court: they won't give you the details unless they are forced to.

    Today I actually received their defence. Apparently I can not include my partner in my claim. They deny they have ever received any correspondence from me, but the best one of all is that they claim the flight was only delayed for 2 hours!


    I know it all hinges on the time of arrival rather than departure, but I fail to see how if a flight is scheduled to leave at 7am BST and arrive at 12.50pm EEST, factoring in a 2 hour time difference, it can be only 2 hours late if it took off 6hr 29 mins late for a 3hr 50m flight.


    I can only conclude that TC are actually operating a fleet of tardis cunningly disguised as aeroplanes :-D




    Ha! After referring this to solicitors cos I didn't want to lose on a technicality, TC have now agreed to pay up! Whoop!

    i reposted for more opinions on wheather to take the matter further or just take what is offered , why do you keep bringing up a disruptive passenger , the captain never mentioned this, nor did any of the flight crew

    The reason is pertinent as, if you go to court, Thomas Cook with submit their defence to show that the delay was outside their control and, as such, no compensation is due. If they can prove that if the disruptive passenger had not damaged the aircraft that there would not have been a delay you will likely lose in court.

    who said the passenger was disruptive , nobody , all we were told is that a panel was knocked by a passenger and that cables were bared and needed to be checked , you should not be able to move inside panels with ease , also why had the first bus of passengers allowed to get on the plane
  • Used the template in relation to flight delays to and from Orlando in 2010 in relation to 7 passengers. Flight delayed by 7 hrs going out and 24 hrs on return. Received a voucher today for £6834, within 4 weeks of my original letter. Contacted TC to ask for cash payment and advised that money will be in my bank account within 14 days. Thank you.

  • Hey fellow giant killers,

    I am about to fill out court form N1 (for multiple claimants) and am a bit uncertain as to a couple of things I'm hoping you all may help with:

    (1) on the top right of the form where the white box says 'IN THE' ,I believe I put
    'COUNTY COURT MONEY CLAIMS CENTRE' but inthe box under neath where it states 'FEE ACCOUNT NO' ,does anyone know what this relates or if it is something I have to fill in?

    (2) there is a white box in the heading above the particular of claims section that states 'CLAIM NO.' , is this for court internal purposes once my claim is received or is it something I have to fill in before sending the form off to the courts?
