I was on a Thomas Cook flight TCK648L on 5th August 2010 that was delayed from the 4th August by 20 hours due to high winds on Kos the plane could not land and was therefor stuck at Rhoads. I used the 'Template' on the MSE website filling in all the gaps including booking reference I posted the letter on the 2nd August by Recorded Delivery so far I have not heard anything should I pursue the matter with ??? (I missed a wedding on the 5th, not mine - but a good friend of mine).0

Try reading the thread called "Flight Delay Compensation Important Info - Please check before posting"0 -
Have posted before but after advice. Booked a package with thomas cook but Pegasus was the airline . Was delayed 7 hours to Antalya . Sent letter to thomas cook they said as Pegasus operated flight it's up to them to compensate. Pegasus say it's down to thomas cook. Bott and co advice says it's Pegasus but they don't take cases on against them as they are not a uk based airline. Where to now?0

I am wondering how long everyone has waited for a reply from TC? It has been two weeks since I contacted them and in my contact with them I stated I wanted a reply within 14 days (I see they say up to 28 days).0

Ring the court to apologise. You should still be able to submit your bundle at this late stage, but do it quick. The airlines do it all the time (even though they employ legal firms who should know better) and seem to get away with it.
Update
I rang the court straight away and told them the situation. The very nice lady on the phone advised me that quite often the Judge will extend the deadline by 7 days so I should still get my court bundle up together and bring it to them. So i did just that, stayed up practically all night researching and putting together my bundle and delivered it first thing the next day to the court. I then received a letter from the court 2 days later stating that the judge has allowed me an extra week to submit my court papers etc (they must have sent that the same day I dropped off my papers to the court)
so now its all go again for 2nd October for our court hearing. very nervous as im representing myself so have got 2 and a half weeks to research as best I can to prepare myself for the hearing. TC are sending down a witness, an engineer and have 1 written witness statement from another engineer and apparently are submitting another written engineer.
I have already noticed a slip up in their defense and evidence they have submitted. on their defense they state that no such aircraft failure has been logged before with the registered aircraft, however on a piece of their evidence which is a copy of their log book I noticed a log recorded at the time of our delay stating that last time this aircraft suffered this failure it was out of service for a substantial amount of time.
thanks for everyone's help so far, even with my stupidity in failing to read the letter properly. this is only the start of my journey though! i expect them to delay the outcome of this anyway with regards to the Huzar case.0 -
Very glad to hear it JB21!
If it is of use, this is my account of my day(s) in court (spread over two posts #389 and 390). Not sure if the links work any more, but if not (and you want them), let me know and I'll try to fix.

Just been offered £640 compensation from Thomas Cook via email. I done this on line on their Customer Service website, and have just got a reply saying they owe me compensation..... BUT they have offered this to me in the form of a Thomas Cook Holiday Voucher!!!!!!!!!! surely I can insist on cash/cheque and do NOT have to take one of their holiday vouchers for the refund. If I am due compensation, then surely it is my right to have this as cash/cheque0
