surely I can insist on cash/cheque and do NOT have to take one of their holiday vouchers for the refund. If I am due compensation, then surely it is my right to have this as cash/cheque

What makes you think that? Have a read of the Regulaton which sets out your rights:

I know! Don't keep us in suspense: tell us the answer! (Is it "Belgium"?)

I've negotiated a deal with the EU where I get paid for referrals to their site. On the basis of the number of posters who've read the Regulation so far, I reckon I could be looking at 10p at least.
  • I have been reading alot about making a "skeleton" before my court hearing. im assuming this is a written list to myself that I am allowed to take in on the day for me to refer to with things like

questions i may want to ask the witness (this would be me cross examining the witness right?)
points I may wish to point out with regards to their defense/evidence?
    etc

    Many thanks

No it's not a list. It's a document you present to the judge and the other side that captures your legal argument in writing.

And yes, you can cross-examine witnesses and eg point out discrepancies in evidence, etc.
  • ok thank you.

Do I present this to them both on the day or is it something I need to submit to the court and send to Thomas cook before the hearing date?

    Many thanks again
  • My husband and I were delayed for around 8 hours on a flight from Manchester to Paphos on 14 June 2011. We were told at the time that there was a 'problem with the plane'. Unfortunately, Flight Stats says: 'We do not have the necessary data sources to detect the arrival or departure of this flight.' Does this mean I can't prove the flight was delayed therefore I can't claim? Any help gratefully received.

No. The airline will have its own records and will confirm whether you were over three hours late (if your delay was eight hours? It doesn't sound very contestable!). So make your claim in the normal way.

Flightstats data cannot be used in court anyway. If the flight was delayed "for round 8 hours" I assume it was delayed "over 3 hours" which is required for compensation
Have a look on one of the NWNF sites such as EUClaim...they have a search on the home page (you do not need to enter any personal details) and it should come back and tell you if you may have a claim. (I had a flight that flightstats showed had departed on time but did not have an arrival time. the flight had departed on time but came back onto stand twice and we sat on it for 4 hours before taking off and EUClaim showed the actual arrival time so I knew I could claim)

You should post on the Thomas Cook thread and see what you are likely to face
