Not sure if anyone else spotted this from the Thomas Cook Group "interim management statement":On 11 June 2014, the UK Court of Appeal ruled in Huzar v Jet2 that technical delays will rarely fall into the 'extraordinary circumstances' defence under EC Regulation 261/2004 as they are inherent in the normal activity of an airline. As such, UK airlines may now be liable to compensate customers for delays caused by normal technical problems. Jet2 are applying to the Supreme Court for permission to appeal the decision and, if allowed, this is likely to be heard in late 2015. In the meantime, and in accordance with CAA guidance, claims will be put on hold pending the outcome of the appeal process. The Group has made a provision of £29 million for the potential impact of the case on claims relating to historic delays. The Group has provided £1.6 million in Q3 2014 and going forward will make additional provisions of £1.5 million per month to address potential claims. Additionally, £10 million relates to the termination of an outsourcing contract.
Interesting figures! Someone with a head for maths (not me!) should do some number crunching ...0 -

Thomas Cook Claim - Settled Monarch Claim - Settled0 -
Hi, I hope this is the right place for my question!
I was delayed with my family for 5 and 1/2 hours at the start of my holiday which ruined the first day. I applied to Thomas Cook and after the full 28 days they replied and said that the flight is nothing to do with them. It is run by Condor and I have to complain to Condor and not Thomas Cook.
Should I pursue Condor or Thomas Cook? Our holiday was booked as an All-Inclusive package with Thomas Cook.
I have a Thomas Cook "Delay Confirmation" that they gave us while we were stuck at Manchester but nothing else now.
Please help if you can, thanks.0 -

If you want to claim flight delay compensation, you need to do so from the airline.
All you need to know is in the FAQs or Vauban's comprehensive summary.0 -

With the Interim management report from TCook in mind, would it be better to go to Small Claims now, with this admission of TC as to their culpability in law re technical issues , or have to bite the bullet and wait until 2015 for an appeal from Jet 2 that may or may not come about and which may or may not be allowed....? I know this is my call but dont want to wait this length of time, especially when TCook admitting they CURRENTLY cant defend against claims refused on technical issues.....
Any thoughts anyone?
cheers
