I contacted TCook back in October/November and was told in December 2013 that the 'extraordinary circumstance' for our flight on 26/10/08 TCX 520K from Man to Larnaca was because 'a fuel leak developed on one of the engines, which obviously had to be investigated. As this had not occurred before, nor had there been any warning of it happening, this falls under extraordinary circumstances.'
I therefore left taking further action because Bott & Co didn't have details of the flight and therefore couldn't help me. I did, however, follow advice on here and contacted the CAA who got in touch with me yesterday to update me on the latest Huzar ruling about extraordinary circumstances. My concern is that due to the flight delay nearing its 6th anniversary I want to know is it worthwhile trying again or will i run out of time reapplying now if the SC hearing (should it be favourable) won't come into effect until 2015 when it would be too late to claim?0 -

I have just received word from CAA re my delayed flight from Sandford to Glasgow 24th May 2011. apparently we have a brand new excuse form Thomas Cook , it was not because our flight had the previous explained as 'technical problems' - 'then mechanical problems'
then icelandic Ash, no none of these excuses , we are now told that there was an air traffic control decision that delayed our plane from leaving Manchester for around 10 hours so it would be clear to any person in this position with Thomas Cook that you will be just plain and simply LIED to, T C have no morals and cannot justify why we were delayed, there were no delays at Sanford confirmed by Sanford., and we did fly into glasgow so there was no ash cloud,
T C just didnt have the plane there for us its as simple as that
so I will now lodge a small claim and show all the different excuses that they have come up with, these people dont live on the same planet as us and believe me the CAA takes the side of the carriers first not the customers despite being 'independent' I have no doubt that people writing regarding this were on the same flight as I and have all different excuses if so please reply0 -
TC do just seem to pick an excuse at random, on our delayed flight we travelled as two groups on two separate bookings. We have filed two claims, one claim was refused due to Technical Problems and the other because of Industrial Action.
The Technical Problems claim has since been paid out after we got a solicitor involved but TC are still refusing the other claim (this claim is now in the hands of solicitors).
If anyone else was on the five and a half hour delayed TCX5245 flight from Corfu to East Midlands on 26 August 2013, I know a very good NWNF solicitor who has already helped me receive my compensation.Cashback earned

How frustrating for you. I think that you have to leave this to the court to sort out. I can't see how the airline won't get the set aside, so there's little point spending money on enforcement in my view.

Call form the Court, Senior DJ reviewed and concluded that the original order stands.. :j
Told Tc to pay, or i will enforce the order
30mins later mail back saying the disagree and they have spoken to the court and its been "re-referred" back to the DJ.. And if I enforce it they will try recover costs form me!
Why do we even have courts! What can i do?

I doubt it makes any difference so I would do what is easiest for you. If you do it online, keep a copy (if possible) or make a note of what you said and the date you submitted.0 -
I submitted a claim to Thomas Cook using their online claim system and also used the letter template and submitted it after having a 4hr delay to Turkey in May. Thought what the hell..nothing to lose.. and today get an email with a £1300 holiday voucher (€400 per person)!!
Very happy with that....next years holiday fund off to a flyer! :j0
