  • I've previously posted regarding this and can see other people have and wanted an update as to where anyone has got with it.

    I was involved in this 27 hour delay on April and have contacted TC 4 times and been told they aren't paying out, I've even gone through the Directors.

    Has anyone got any further with this, I was thinking of creating a Facebook group for this, if anyone could contact me who was on this flight would be a good idea.

    How frustrating for you. I think that you have to leave this to the court to sort out. I can't see how the airline won't get the set aside, so there's little point spending money on enforcement in my view.

    Brett: you gotta get a grip of this. Either start legal action or accept you're not getting any compensation. Writing letters and setting up Facebook pages ain't worth jack.

    If you are planning on pursuing your claim (assuming it's rejected) have a read of the FAQs or speak to a no win no fee firm

    9 hour delay from Bristol to Enfidha on 31 May 2014 on TCX7294....

    finally got a response from Thomas Cook agreeing with my claim :j
    offering vouchers for our next holiday :mad:

    writing the letter of complaint to point out we can have cash as we speak...
    Excuse any mis-spelt replies, there's probably a cat sat on the keyboard

    Hi I used the template and my compensation claim was accepted however they want to pay me with a Thomas Cook voucher. Is this the only option or can I ask for a cash refund?

    I was delayed for 24 hrs on tcx 138 manchester to goa on 2.3.14.
    I have been in contact with Thomas Cook regarding compensation.
    They are saying that none is payable because the technical fault was an horizon indicator failure which historically had never happened before.
    In their latest letter they say that they are being "open and honest" and are adamant that these were exceptional circumstances.
    Can anyone give me an opinion - is this an exceptional circumstance, or are they not being "open and honest"?

    They can be as open and honest as they like. Incidence of a technical, or indeed most technical issues are NOT extraordinary or exceptional circumstances, according to the Regs, wallentin or Huzar. Unfortunately it is likely you will have to start legal action or hand over to a NWNF company, such as Bott & Co. Other companies are available.
