    They will have moved it to manchester as TC's based at manchester airport so more people to pick from to act as as witness whom were not there. You can claim all expenses and and this to your costs including loss of earnings. My case is at manchester and the huzar case first appeal was so they know all about reg 261/2004. I would object as the whole point is not for their convenience but yours.

    Yes you can object. As litigant in person and the claimant, versus large business, you can request the case be heard at your local court. It will be in the Civil Procedure rules somewhere (someone more learned may know the relevant section)

    Thanks to you both, I'll get reading and see if I can find anything in the Procedural Rules..

    Interesting, I just called the court and the files have not left the building. Therefore they are going to hold them and place my email of objection before the judge before they are sent.
  • Hi I'm new this here goes,firstly has anyone else contacted Thomas cook about flight TCX2066 from Manchester to palma 03/06/14 ? We were delayed for 4 hours 15 mins due to a technical fault,I have contacted TC twice only to be told their sorry but I'm not due compensation,should I pursue this or am I fighting a worthless battle ? Any advice would be greatly appreciated.Thanks x

    In 2008 I was on a package holiday with Airtours to the Dominican Republic when we were subject to a 24 hour delay for our return journey to LGW.
    We were allowed to remain in the hotel for the length of the delay. Following the new ruling I have submitted a claim via the Thomas Cook website which they have acknowledged and are investigating. However the website is now displaying the following statement;

    "Following the recent ruling of the Jet 2 vs Huzar case on Wed 11th June, we would like to clarify our position for customers regarding the claims process for delays in relation to Regulation 261/2004.
    Jet 2 have officially announced their intention to appeal the decision of the Court of Appeal, so there is currently no final legal clarification available on how customers claims should be treated in relation to technical delays.
    Until the appeal case has been heard, Thomas Cook will continue to use the guidance issued by the Civil Aviation Authority & nbsp;(CAA), who are the UK’s National Enforcement Body (NEB) for Regulation 261.
    Once the appeal has been heard we will post a statement on our website outlining our revised position."

    Is this a get out of paying tactic?
    Am I entitled to anything as I was accommodated? Will this be classed as adequate compensation?
    Any advice would be greatly appreciated.
    Is it slightly ironic that I used to work for My Travel and this holiday was a staff booking?!

    If it was a staff booking with an airfare discount not available to the public then you are not covered by the Regulation.

    You can use the Search this Thread at the top of the thread and search by flight numbers etc but with the timescales they often take to respond I would be surprised if anyone had a successful or unsuccessful response after this time period
  • Hello all, I seem to have some success with Thomas Cook with an 8 hr delay due to no flight crew and ending up on a spanish airline from Stansted to Majorca early June. I have been offered a holiday voucher rather than a refund with the email making it quite clear that this is the end of the matter. Should I push for money as, to me a refund implys money not a holiday voucher, the amount is over £800.Thoughts? Thank you
