If it does get to court all I am planning on doing is turning up and reading out the CAA statement.
I'm not sure that would give you the result you want. If you go to court, you need to present your case.Would employing one of those lawyers specialising in FLight Delays really enhance my case at all?
It shouldn't do in theory as your case is your facts. In practice, possibly but more importantly it would relieve you of the effort of preparing your case - at a financial cost, of course.0 -

I haven't had their defence through the courts as yet, I'm just going by what they've said all along in their communications - ECs, and also as it said in the letter they gave us the next day back in 2012, when our flight eventually took off.
Surely I don't need to wait to get their actual defence through, do I, it may not come which would be good too, but not sure if you're inferring I've received their defence, cos I haven't had anything official via the courts system ?
I've made our suggested changes btw, removed interest and marked it open offer. thank you.
Just as an update - started proceedings with TC in May and the date that they have to replied by is approaching, with no response to date.
I received a letter today from TC thanking me for my letter(?) and to give them 28 days to carry out an investigation(?) - it was dated 24th June and I received it today!
The address, though postcode was correct, said Co. Durham - I am in Northern Ireland.

Hi, I have just returned from my holiday in turkey. Just need a bit of help please. On my outbound flight from Manchester to dalaman with Thomas cook we were delayed 5.5 hours. When filling in the letter to send to tc it asks what sum of money I'm requesting. I've looked at the table with prices but is turkey classed as in the eu? If not then the only option is 3,500km+ travelling eu to non eu. But our flight was 3030km only. Can anyone help me. Thanks rachel0

hello all, quite new to this, going to read the thread on taking the airlines to court but in the meantime any advice would be gratefully received!
We were on a flight to Enfidha Tunisia in March 2013 at 9 a.m, we boarded on time but, while still on the runway, were told there was a problem with the reverse thrusters, we then were "driven" around to a maintenance area where a man got on a ladder and tinkered about with a hammer for a bit! We then were taken off the plane and given a voucher for refreshments. after about an hour, we were allowed back on, we took off and about 15 mins into the flight, we were told that we would be returning to Manchester due to a fault with the on board computer. on landing, the fire trucks were waiting for us, I assume this is standard procedure but it was still very scary!
we finally took off on a new plane at around 4 p.m, arriving at our destination at approx 10 pm instead of 2 p.m.
I sent the template letter from here (thanks) in May 2013 to TC customer servcies Bradford by registered post, it was received and signed for, I got no reply or acknowledgement that they had even received it. I wrote and emailed to no avail, in the end I sent it to the CAA. They never really contacted me unless I asked for an update and then I was told there was a backlog, until recently when they told me that the cases had been referred back the airlines due to a change in legislation and that I should re submit my claim to TC.
I sent the template letter (again) on 13 June 14 and it was signed for on 16 June but I have still had no correspondence from TC.
I'm unsure as to how to go ahead and fight them when they won't even reply to my initial complaint! thanks folks0 -
If TC are not answering your correspondence lisajane, you have two choices: either walk away, or start legal action (yourself or with a NWNF company). The FAQs on page one have all the info you need.0

My claim for compensation to Thomas Cook has now been allocated to the Small Claims track at my local court.
I have arrived here via:-
1. Email to Thomas Cook - Rejected claim.
2. Email to CAA. Eventually replied and agreed compensation was due.
3. Letter to Thomas Cook asking for compensation as agreed by CAA. Thomas Cook rejected.
4. Moneyclaim Online application to Thomas Cook for compensation.
I have now agreed Small Claims mediation ahead of a hearing.
My question is. Has anyone else got to this stage and what is their experience? If we cannot agree a compromise, what's next?
I would accept holiday vouchers if offered but I guess they may not even be prepared to do that.

When were you delayed? Why were you delayed? And what did the airline say was the reason for refusing you compensation?0 -
Looks like TC are playing hard ball to the end. Sent my court questionaire to them and they declined mediation. Got a hearing in my local court here in the south, so thought that's good. Now today I received from the court that the case has now been moved to Manchester. The grounds are that as well as the defendant they have one witness and it would be more convenient.
Can I object to this? It would mean over a 4 hr drive both ways and probably an overnight stay. Just even more expense..
After jumping through all these hoops for well over a year, I am truly losing the will to live...0
