I presume you mean flight TCX2514 Manchester to Hurghada. I was on the same flight and at no time did they mention safety issues, in fact they have stated in the letters they gave us at the time that it was "delayed due to a technical issue". The plane never left the ground so an engine that wouldn't start, to me, doesn't pose a safety issue. Planes that have taken off and then have engine failure are a safety issue.
I don't understand how the crew being out of hours comes into it as they had no plane to fly us in so no crew were needed!!!
I am in the process of sending letter and will post any reply.
  • Thanks for your post.

My flight was the one you were on coming in from Manchester. we were waiting for it in Hurghada. Surely, there's a payout here if we persist.

    I'll keep you updated.

Somebody on the flight that I kept in touch with says they paid £1000 + a free flight but can't send me any copies of correspondence so I think it might be exaggerated. If she only got the amount she was entitled to it would prove they accepted liability but to date she has not been able to send me copies. If I do receive any copies of correspondence I will post these.

I think we would all be beyond astounded if an airline paid more than they were legally obliged to.

If she was paid what the Regulation provides, that is interesting and possibly helpful but I would, again, be amazed if "they accepted liability". If anything, I imagine they will have paid as 'a gesture of goodwill'.

I agree entirely, that's why I asked if she could send copies of correspondence but she says she can't scan, so I will proceed without and see how I go on.

returned from turkey early part this year 2014, flight was delayed 6 hours on return, was told by ground staff that some form of transport had hit plane back in london, thought no more of it, till i got back and was told it was technical issue, two different stories already, wrote to thomas cook, fed me a load of other crap, so started small claim, within four weeks, had reached a deal out of court, and nearly £2,600 returned, booked tieland happy days.

First, pls dont start your own thread - use the dedicated TC one, and people will try to help. Let us also know the date. You have only a matter of weeks yo start a legal action before you are out of time.
