  • I was on TCX908K from Manchester to Santorini on 31/08/2010 (delayed 8 hours) and TCX908L from Santorini to Manchester on 14/09/2010 (delayed 7 hours). I lodged my claims for compensation with Thomas Cook in October 2013 and received no response. I complained to the British CAA, who said that the delay to my outward flight was due to "extraordinary circumstances". The Greek CAA asked TC for an explanation for the delay to my return flight, but TC did not respond. I then started proceedings through the small claims court for compensation for the return flight. TC initially filed a defence, but it was pathetically feeble and only required me to produce the invoice for the booking, which I did. Only when a hearing date was set with York County Court did TC finally cave in. They have paid me £335 (i.e. 400 euros), plus my initial court costs of £35. They could have paid this in October and saved themselves the costs and everyone a great deal of paperwork. I know, through this forum, that they'd already paid others who were on the same flight. Thanks guys.

    Badger: I bet you a pint (of badger ale, naturally) that if you had started an action for the first delay, the airline would have paid out for that too. Never go the the CAA - they side with the airlines, not their passengers.

    We are still pursuing the outward flight TCX908K Manchester to Santorini 8 hours delay. I received an email after a year from the CAA stating "extraordinary circumstances" but then saying it was a technical fault. But the delay was caused by the late return from maintenance and a part needed "Flap Drive Unit" that had to be obtained from Luton.

    I wish I had never contacted the CAA they are hopeless, my daughter works for a national airline in operations and she says it is a requirement of the airline to provide a substitute aircraft, I do not know if this relates to charter airlines.

    Anyway I am with a NWNF company and I will let you know how I get on.

    I did wonder whose side the CAA are on. I haven't ruled out pursuing compensation for the outward flight, but went for the return flight first as it was more straightforward and I've no previous experience of compensation claims. I can now start badgering Thomas Cook over the outward flight.

    Thank you doz123 - it was your experience that gave me the confidence to go for compensation for the return flight.

    I got the same response from the CAA over the outward flight. Many cases apparently have a stay of proceedings pending the Huzar v Jet2 appeal. If that goes in our favour then it should make our claims a lot easier - the airlines will have no defence.

    Hi, I have recently sent of my letters to Thomas Cook for my compensation as the flight was delayed more than 5 hours, see below for replies
    • Letter sent back saying ticket stub I sent in was not acceptable
    • Contacted CAA who said it is and contacted Thomas Cook
    • Received email and letter last week to say that we have got your details but due extreme circumstances for the delay we have no claim
    • on the same day another email came through saying the delay was not long enough for compensation (5 3/4 hrs)
    • contacted the CAA again and passed all info on
    • the next day received another email saying I will receive £1006.00 in vouchers, which works out at £335 per person, but seen as there is 6 of us only works out at £168.00 per person
    • I have contacted Thomas Cook and said I want cash and the amount doesn't add up.
    I will post again as soon as I have heard back from them but is looking good

    If this is Man to Dlm, it should be 400Euros per paying passenger. So that indeed seems to be the amount for three people.

    Good that they've acknowledged a payment is due, you just now need to hold their feet to the fire to get the right amount.
