I have been told all 261/2004 cases have been stayed at County Court because of the Dawson Case dealing with the Montreal Convention and its limitations and the Huzar v Jet2 case again dealing with technical defects at the Court of Appeal. The decision is due in May 2014.
Anyone having the same issues and things ground to a halt????0 -
I have just received an email confirming that I can have cash instead of vouchers. I had to 'phone the number given, quote the new reference number. I spoke to a human being who was very nice. She took my bank sort code and account number. She told me that the £2033 would be in my account within the next 10 days. I
received an email confirming this. Pending the brass actually arriving in my bank account I would like to thank everyone on this forum for their help and encouragement. The Martin Lewis website is a boon. I say to all those folk out there seeking compensation: keep on trying. My claim was for over 2 years ago and all we had was a flight number still fastened to my grandson's suitcase. We had no booking reference, the online travel agent [Coop] had been taken over [by TC] and closed down. Thanks again.0 -

Indeed. My case wasn't stayed the other week either, and there have been others who've won their cases in the interim. It does seem unfortunately to be a slightly random process, and always at the discretion of the judge.
I don't see much advantage in claimants agreeing to a stay, if asked to by the airline: it costs the airline money properly to apply for a stay, and - given how many hoops they make claimants jump through - I'd make them do the same for once and pay 'em back in their own coin!0 -
Ok, this is for those people that are struggling to find information about thier flight or delay.
The site I used is very good and you do not need to register.
To find you flight details just click the playback icon and put in your details or date and you flight will be played back. I found all mine on this. I hope this helps as it did me.:)

Query around SARs
Template letter sent out on 25 January and no reponse
I have gone down the NWNF route (Bott & Co), but they are asking for confirmation of booking or boarding passes before proceeding
We have no booking confirmation (all done over the counter in a travel agents by another member of the party and subsequently all docs thrown away - yes, I know) or boarding passes. We do have the booking confirmation number, flight numbers. It was Manchester to Tenerife, so no passport stamps
There were 4 people on the delayed flight. Does each member of the party have to submit a seperate SAR to prove that they were on the flight?
Can anybody confirm that the SARs go to this address?

How do you have the booking confirmation number if you've lost all the documents? Have you tried approaching the travel agency - others have done this before, and their details are still on their system.0 -
I have tried to get compensation for 5+ hours delayed flight TCX116 11th October 2012 LGW to Varadero. Have tried the CAA but failed. The CAA state that the delay was outside the control of TC who could not have done more to avoid disruption but could not give details of the technical fault. After several emails to TC I have at last discovered that there was a blocked jet on the aircraft which needed attention. However TC refuse to answer my questions regarding where & when the fault was discovered & if this caused delays to flights prior to 11th October 2012. By using flightstat reports I find that TCX135 arrived at LGW on time at 07:05 10th October 2012. TCX412 LGW-Cancun due to leave at 10:00 that day was delayed by 362 minutes, thus causing 299 minute delay to TCX413 Cancun-LGW and probably 297 minute delay to my flight. TC certainly knew about the problems with my flight on 10th October as I was informed of delay at twilight check-in on that day. Has anyone received successfully compensation for any of these delays? Time for TC to be honest. I have given them a lot of my money in the past - it is cashback time!!0

I had a record of the booking reference, but the documentation has gone. Approaching the travel agents (Thomas Cook) is next. I still wouldn't have proof of being on the flight, hence the query about separate SARs0
