Think nearly 11 years ago is stretching it a bit far.

    You mean 2013, presumably.

Finding another passenger won't butter any parsnips, unfortunately. You have to take this on yourself or go NWNF.
  • Hi folks, new on here, but have visited site numerous times in the past.
I am after some advice about a flight delay last year, it was from Enfidha to Newcastle upon Tyne and flight was delayed by 3 hours and 5 minutes. I went through the procedures set out on here and contacted TC, who said it was extraordinary circumstances. Went to CAA, who referred it back to TC for a reassessment. TC replied still stating it was extraordinary circumstances and would not pay out, they also said in their last email that case was now closed.
The fault was a technical fault on the plane that was due to bring us back, and they had to fly a replacement plane out from Manchester to bring us home. Our original plane was still on the ground at Newcastle when we flew in.
Can anyone give any advice as to what to do next please, ie do I contact the CAA again? Or start along the small claims procedure, (there were four of us travelling by the way). Any advice/assistance greatly appreciated.

If you say you have visited the site numerous times I cannot understand why you have approached the CAA as any approach to them can be detrimental to your case. Firstly as your delay period is so close to the threshold have you documentary evidence as to the fact the arrival delay was over 180 minutes when compared with the scheduled arrival - if so and yours was a technical problem you have a valid claim to pursue via the small claims application.
  • I went through the procedures on the Watchdog site as there had been an item about it. It said to go to CAA if no joy from airline.
Flight was delayed, (flight TCX6015 on 18/7/13,scheduled arrival in Newcastle 03:50, actual arrival 06:55, confirmed on flightstats).
We were told it was a fuel pump problem, my view is that as the scheduled plane was at Newcastle airport, presumably scheduled to fly to Enfidha full and return with us, why was there not some alternative already in place? I can't see them flying out an empty plane. We were told that there was a delay when we entered the airport.

I am no expert (although I have gone through the court process) however a read through posts on this forum will indicate the CAA are useless and if they do side with the airline this can be detrimental to your case. A fuel pump problem is a technical problem which is not extraordinary however you may wish to wait until the Huzar appeal is resolved as this may well have a bearing on your claim. I have messaged you regarding another matter.

Success....finally. After the usual letters and "MOT" responses, started court action in November. Received a non-specific EOC's defence and came to the conclusion TC were clearly stalling hoping I'd go away, especially as they declined Mediation. Had a Court Hearing date for later this month, but eventually received the magical "we've reviewed your claim" letter in February, and payment now in bank.
For those unsure what to do, you can do it yourself but be prepared to put time and effort in researching the background. If you are lucky to get a defence specifying what the core issue is, you can at least make an informed decision whether to pursue the claim. The last thing you want to do is submit MCOL claim and then get cold feet further down the line, as this will end up costing you money.
Good luck fllow MSE'ers with your claims.
