Actually, I'm not surprised by this. Neither airlines nor anyone else are required to retain personal data, unless there are clear operational reasons for them to do so. Indeed, it is good practice for organisations to dispose of personal data once it is no longer required.

I suppose it's because we see so many mentions of the 6 year limitation period as it applies to delay claims, but obviously also to other claims, that I thought they might look to that as some kind of standard.

Also, I wondered whether airlines might be required to keep data for "security" purposes. For example, if "the law" wanted to know if someone had travelled to a particular country, etc..

    hi

well I have bit the bullet so to speak , got off my butt and finally decided to try and claim - we were delayed in Menorca august 2008 well over six hours . just done everything and will post letter tomorrow ,found booking reference and letter form travel agents so I'm hoping that will do the trick - used the template from here, so nothing ventured nothing gained .

had email from tc the other day saying looking into case , and then this evening had two emails within minutes of each other saying they looked into case and are giving us compensation :j - now my question is this do children not qualify for compo? as it was myself my now husband and our son who travelled ( son was 5 at time and had own seat) they are compensating us for two passengers not 3 ! also they emailed me a voucher and I have emailed back asking why only two passengers where given compo and could I have cash , am I within my rights in doing this ? am I being too cheeky

Totally within your rights - cheeky > NO - TC may think they are being cheeky ~ others may say dishonest so cash x 3.

The other side of the coin is that if they have no details of you they can't defend that you wasn't on the flight!

I would go NBA now, and then issue court proceedings. Beware of your date to take action running out.

    Good point Mark2Spark!
I have got info from ICO website and sent Thomas cook e mail saying I believe I have not been sent all the data Im entitled to,and if I don't receive a satisfactory response will submit a ' request for assessment' to the Information Commissioners Office.

I believe you are just playing into their hands and playing their game of correspondence tennis. You were delayed over 3 hours and you are entitled to compensation if delay not due to weather or a few similar related 'acts of God/terrorism'.
Recommend going to court now either DIY or NWNF.

It seems I cant go NWNF without flight number, and presume I would need some form of proof I was on the flight if DIY,but I have nothing, apart from the passport stamp which obviously proves I travelled but not who with!
As flights were booked through the internet I don't have a Travel Agent to find details either.

Do you know the dates of travel, the route and the airline? If so, flightstats.co.uk gives you the flight number.
