Hi all, just completed claim form with Bott and Co for our 12 hour delay from Enfidha to East Midlands August 2013, so here goes!!0

Has anyone made a claim for this delayed flight?
It was 4.5 hrs late into LGW. I've emailed them and used the MSE template letter but have received a reply saying they will not pay any compensation.
Looking at the thread it does appear to be a very standard reply, comparing a technical problem to your car breaking down, even though you've had it serviced.
As the flight was FROM GNB, the CAA website doesn't help. I've tried calling them but just on hold for ages.
So, I wondered if anyone else has had any luck? I've searched flight number here and can't see any previous thread.
Thanks all ...0 -
I meant to do this a while back -but wanted to say a big thankyou for the advice on this forum and to Gorbar for sharing information on her claim against TC - my parents were on the same flight and TC have recently agreed to pay out after I informed them that I knew they'd paid out already to others on thE same flight. My folks were chuffed. POWER TO THE PEOPLE!Once they have agreed to pay, how long is it taking them to send the cheque. I have looked & it. Appears it can take from 1-2 weeks. Our NWNF informed us on 8th October that they would be paying, according to them they have still not paid. Our day in Court was next Tuesday, I would have thought they would have paid before then. VERY, very annoyed that they are being allowed to drag it for so long.
Any help would be appreciated, just wish I had a number for their legal dept.0 -

Whether anyone has or hasn't doesn't affect in the slightest your own prospects for success, of course*. It is clear what you need to do next if you want your compensation ...
*though blahwaffledrone's post above mine is interesting. Most airlines simply say "no precedent has been set" or "confidential settlement" or whatever.0 -
Hi all - I'm brand new to the MSE forums so please be kind!
Firstly thanks to everyone who's posted on this thread before me for the wealth of information - spent quite awhile reading up over the last few days, and it's been an education.
Just to share, I've contacted TC regarding two delays - consecutive summer holidays - after finding out about the EC regulations on delays. I used the link from this site to register the 261/2004 claims.
To the surprise of absolutely no-one I've got 2 bog standard "Extraordinary circumstances", "it's like an MOT" replies. I know what to do next - NBA letter's being sent, thanks to all the FAQ's. Cheers!
Don't have any questions (yet!) but wanted to share my flight details in case anyone else is claiming on the same flights. I could see Bucket and Spade is pursuing the TCX6402 flight through a NWNF.
I'll share my experience in the hope it can help someone else - and obviously pick the brains of the users who've already been through what I'm about to do.0 -
Well done for doing the legwork CM: sounds like you are across this.
Good luck with your claim!0 -
Has anyone been successful on claiming for this 5 hour flight delay?
In the airport we were informed that there was a technical fault, they then had to send a vehicle to Heathrow to obtain the part.
I have just had the standard 'extraordinary circumstances blah blah blah' letter back.
Considering my options, so any advice would be appreciated :
1) Issue a letter before legal action (MCOL) and also obtain names and addresses of Directors from Companies House and send them copies.
2) Get a solicitor on a no win no fee.
3) Forget it!!
I hate the fact there is a rule in place and airlines seem to think they don't have to abide by the rules (much like the banks!!!), so happy to lose a bit of money in fees to satisfy my indignation.:(0 -

Yes, those are exactly your options.charline66 wrote: »obtain names and addresses of Directors from Companies House and send them copies.
Completely pointless. At the margins, a judge might regard it as a tad aggressive.0 -

I had a flight delay with Thomas Cook in September 2008,and have no paperwork at all, just a stamp in passport!
The flight is not showing on Flight Stats.
I have sent my £10 and requested a Subject Access Request.
Have received a reply today with no information until September 2011 as they don't have to keep details that far back.
Is this the end of the road?
Any advice gratefully received.0
