Hi all, we were delayed by 12 hours last August from Enfidha (Tunisia) to East Midlands. Completed the direct complaint form we were directed to from the main page. Have had TC's reply within 5 days saying
"Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. The aircraft displayed different error messages each time during previous technical events. Engineers carried out the correct maintenance for each incident.
In line with Regulation 261/2004 a payment of compensation would not be considered applicable in this case."
The problems occurred with the plane before it left the UK to collect us.
In line with the advice on MSE, I wanted to contact the Regulator in Tunisia, however, I can't download the information on who it is I need to write to/email or the template letter for this, as it keeps going to notepad. Can anyone help?

How do you think the Tunisian NEB will help you? They have no obligation to investigate, as they are not a member of the EU. In these circumstances, the CAA would investigate. But, as you'll see if you read this forum, most experienced folk here wouldn't advise going to the CAA.
Your options? Small claims court, NWNF lawyer, or let it drop.0 -
Thanks Vauban. Have entered initial details into Bott and Co's claim checker, and it looks as though we could have a claim. Just going to wait for the other half to get home and discuss with him, but think that is the road we will take. Will keep you all updated on our progress, and many thanks for your assistance x0

Just returned from Egypt following a 6 hour delay. Was told about compensation by a friend so thought I would give it a try. In 2 days Thomas Cook accepted liability and agrred to pay out £505 x5 for each member of the party.0

Regarding flight TCX2663 Schedualed to land at Manchester at 11.35Pm on 25/9/2012. According to Flightstats.co.uk the official landing time for this flight was 04.40Am on 26/9/2012
I sent an email to TC claiming for this delay on 25/10/2012 . I now have had a reply from them. This is the relevant part of the letter.
'Although delays are rare, they can arise for a number of different reasons, and having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature, which were extraordinary, despite Thomas Cook taking all reasonable precautions necessary to prevent the situation. All aircraft can experience technical problems that are totally unforeseen, despite all reasonable attempts to ensure they are maintained to a good standard, in line with CAA regulations. These situations can be compared to the maintenance of your own car, which can break down at any time without prior warning, regardless of it's service history, and would be considered completely beyond the owners control.'
I have emailed them back asking for details of the 'Technical problem' so that I can pass this on to the CAA for their interpritation and also as evidence in a law court..
Will post any reply I get.
A year after putting in my claim and a month after CAA came out on my side TC have paid up £676 for the two of us. Tried the voucher thing first though. Took CAA 10 months too decide also. Don't give up folks!!! be patient.0 -
My claim for our delay from Corfu to East Midlands is currently in the hands of the solicitors appointed by my house insurers.
The last letter I received said they were awaiting disclosure of documents from Thomas Cook but said it may take some time as airlines are dragging their feet waiting for the outcome of a hearing regarding technical difficulties being classed as extraordinary circumstances at the court of appeal.
Anybody know anything about this case at the court of appeal? Like when it is being heard?Cashback earned
