I expect you are correct, but it's not easy to sort that 9 months after the event.

In any case TC don't care, their lawyers don't care and the Courts don't care.

There's not even certainty they'll pay without the need for bailiffs.

Actually it's very easy: there are loads of websites that give you historic exchange rates. It's quick and easy to work out). On the day of your delay, for example, €1200 was worth £991 and 20p!

I wouldn't advise that anyone inflates their claim through the deliberate misapplication of incorrect currency rates. Not only is it dishonest but it will damage your credibility with the Judge if you are found out.
  • Hi all

Wondering if anybody can help. I was on a Thomas Cook flight from Las Palmas to Manchester in October that was delayed 3 hours 50 minutes due to a technical fault. The takeoff was rejected and everybody held onboard whilst the engineer fixed this "common" fault with the reverse thrust system.

We kept being told that the delay would be 30 minutes, then another 15 and so on... We arrived 3 hours 45 minutes late into Manchester and I believe I am entitled to compensation for such.

I have approached Thomas Cook directly and been given the standard nonsense about extraordinary circumstances etc so I am considering sending a letter before action and then following it up with an MCOL should they not play ball. There was only me traveling so it's a matter of principle now rather than a huge financial incentive.

Would the above be the best form of action to take, also whats the best address to write to Thomas Cook at rather than emailing and also to serve the MCOL to?

I understand it may take a lot of work, however, fortunately for me I have all the announcements onboard recorded and I visited the flight deck and spoke to the pilots who told me the exact problem and I was lucky enough to be able to look through the tech log for that flight too.

    Thanks in advance!

The best action to take is to read the FAQs and the TC thread where you will find everything you need to assist you in making your claim.

I wouldn't get too bogged down in the details of the "fault with the reverse thrust system". It's a technical problem which is as much as you need to know.

You should use the commercial exchange rate on the day of the delay.

Yahoo Finance is a useful source:

I have read the FAQ I just wanted an opinion on what course of action I've decided to take.

Fair point - Thomas Cook got pretty shirty with me when I told them I knew the exact reason for the delay, ending their 2nd email with "any further correspondence with Thomas Cook will go unanswered".

Your choices are do nothing or take legal action. If you take legal action, it's DIY or no win no fee firm.

There is a Thomas Cook address linked from the front page of the FAQs. I always write to the company head office which a google search brings up.
  • Hi Vauben

Since posting I found and read your account of your court experience with Monarch. If I wore a hat I would take it off to you.

You obviously know far more about this business than me, but my comments about the Euro/Pound rate are based on my personal experience, and with the benefit of hindsight, I would have claimed a higher rate of exchange simply because nobody, and I mean nobody, has made any attempt to challenge my maths.Perhaps there are hard and fast rules about this - but I missed them.

Hopefully will never have to claim delay compo again.

You enjoy your payout - you've certainly earned it!

I do understand your point, CB - and am grateful for your kind words.

I had a similar experience in court, not over currency rates but interest. I had worked out in advance what 8% would be, and the judge was happy to take me at my word for that without resorting to a calculator!

Whilst I could have "rounded up" or "bulked it out" further, that would be based on a lie. It's incumbent on all sides to be honest during the process.
  • Hi
Can anyone tell me if compensation is due on an outward and a return flight - we were delayed both ways in 2012 for over 5 hours on a flight to and from Menorca.

I have claimed as per the MSE advice direct to Thomas Cook and they answered almost immediately with an offer of £326 per passenger in vouchers in full and final settlement.

I am currently writing to them to tell them I do not want vouchers as I am unable to travel within the next 12 months.

My question is we were delayed going and and coming back, and we would have got the above amount if we had only been delayed on the outbound flight so should we get the same for the return flight aswell?
