Just received my response from TC in relation to my NBA letter.. another fob off!

Please accept this correspondence as a response to your “Notice before Action”. As previously advised a decision has been made, Thomas Cook remain satisfied that we took all measures to prevent the delay and feel that the delay to your flight was extraordinary circumstances. Again please be advised that your case is now closed.

I do hope that I have clarified our final position on your case, and should you seek more formal advice, we will await to hear from your appointed legal representative.

    Kind regards

As anticipated. Time to show you are serious and take them to court.

David I guessed that would be the response, as it appears to be the usual standard fob off letter.

Can I ask are you taking action yourself or using a NWNF firm?

I'm going DIY. I'm not a lawyer but have some experience of dealing with legislation (but not the court process). To be honest, the amount of time I have spent to date is significant so it's not just a question of the cash you "lose" if you engage a no win no fee firm; you gain a lot of time and freedom from stress!

Ain't that the truth! My claim was for €3000, so it was worth me spending the time to do this myself (a NWNF firm would have taken about €1k). But it really does take up a lot of time, and if it was just chasing a few hundred euros of compensation, I'd think about NWNF (well, Bott - less sure about some of the others!)

In my case I wasn't particularly bothered about the cash, I just wanted to see the Airline stuffed for telling a pack of lies and to demonstrate how inept the CAA is.....Bott &Co. did that on my behalf!

There is a great deal of satisfaction also in seeing Vauban et al being successful with their DIY claims against the airlines.

My claim is for €1200 for both myself and Mum. i have spent the past week emailing Harriet Green and her team, so I have already taken up a lot of my time.

I take it once I file the claim online I just sit back and wait?

I have read up on Bott and the success rate.

Yes.......if the NWNF solicitors accept the claim then you just sit back and wait. There may be a time lag because of the Appeals currently in the process of being determined but don't let that put you off.
