Flight delay and cancellation compensation, Thomas Cook ONLY

In looking into NWNF for my delayed flight in September 2008,it seems I need to give the flight number. As its not on flight stats and Thomas Cook are telling me they only have information from September 2011(when I asked for Subject Access Response)I seem to have reached a brick wall.0

Due out on this flight this morning - apparently it has been delayed 24 hours due to problems with the inbound flight.
Question is, does a delay of more than 4 hours on the incoming flight count as an "exceptional circumstance"?
Personally I would expect an airline to be able to russle up an alternative plane (particularly as the flight is setting of from what is meant to be one of TC's "hub" airports)
Seems the inbound flight was TCX147 from Barbados (also delayed 24 hours).
Anyone been given any excuse as to why the Barbados flight was delayed for so long??:mad:0 -

Only your flight that matters - if your flight was delayed 3 hours + then you are entitled to compensation particularly if weather problem (to your flight) was not a contributory factor.0 -
I would be interested to hear from anyone who was on the delayed Thomas Cook flight TCX373 from Barbados to Manchester (after a P &O cruise) on 17.12.11,
not departing until 20.50 on 19.11.2011.
After extensive correspondence with TC and advice from CAA that this delay was not due to extraordinary circumstances, TC have refused to accept responsibility or pay compensation. Iwould be interested to know if anyone has claimed or received compensation for this delay.0 -

We were on the plane delayed for 51 hours and are in the process of taking TC to court. Am interested to read that you think you returned home on
the plane we should have. Do you have any info that might help our claim.
Did you claim successfully?0 -

Which post were you responding to?
I can't believe they have the brass neck to defend a 51 hour (4 day!!) delay!0 -

Not a great help but I'd be tempted to contact the Information Commissioner or maybe the CAA, and aak them what passsenger information should be retained and for how long. It seems like a very convenient way of avoiding older delay claims. If they are potentially in breach of some information retention requirement, that may mean they can find it when you ask again.
Have you posted the date and route in case someone recognises it? Have you looked throug the thread to check no-one else has discussed that flight?0 -

Actually, I'm not surprised by this. Neither airlines nor anyone else are required to retain personal data, unless there are clear operational reasons for them to do so. Indeed, it is good practice for organisations to dispose of personal data once it is no longer required.0 -
Flight FZ37AM Cardiff to Paphos 13/09/09, this flight was delayed for 11 hours, thanks to advice on this forum I applied to Thomas Cook for compensation.Last October, I received an email acknowledging my request and quoting me a case number, nothing happened despite two emails to Thomas Cook requesting information. In January I posted a letter to Thomas Cook taken from the template on this site enclosing a copies of my two previous emails also copies of the flight tickets. On 18th February I received an email offering me vouchers on which taking advice from this forum I refused, two days later another email arrived asking me to ring their office with my bank details, last Friday £668 was paid into my bank account, the full amount of compensation, £334 each for my Husband and I, this being the full amount due to us under the EC regulations.
My thanks both to Martin and to this forum for all your help, it has been much appreciated
Good Luck everyone
