Hi all was wondering if any members could help me I was delayed over 24 hours from Goa to manchester. Following advice on here I used the template and sent all documentation to Thomas Cook they replied citing extraordinary circumstances. I then followed next procedure and wrote to CAA who after ten months I received their findings yesterday which were in my favour. They have advised thomas cook to pay compensation but they are refusing. Is it worth going down the route of court action as really unsure which way to go now. Thanks in advance for your help.

What other alternative do you have? Apart from to walk away. Should be an easier claim with the CAA finding in your back pocket.

    Hi All

found out today that my local D Judge has NOT stayed my case. T COok wrote to court asking for it, and he has stated it wasnt a formal application, I opposed it, it wasnt appropriate to be dealt with by way of a paper application and will deal with it next week in Court.

Am well aware he may still stay it once we all arrive at court but, fingers crossed.

Anyone got an tips re immigration. one of the defence heads is that the airport in Las Vegas wouldnt let us set off (due to the delays) or give us a slot and this was an 'exceptional circumstance' according to Thomas Cook. Surely this is quite common in the day to day running of this type of business but am struggling to find anything on the internet with specifics. I just want to dot my i and cross my t!

    Any help much appreciated.

    Thanks

    Ju

This arguably could be something out of the airline's control (like air traffic management decisions. But didn't you say that your delay was over 30 hours? And were you stuck in Vegas or was it an earlier flight, causing a knock on?

Rather drives a coach and horses through the CAA Chief Executive's defence of his organisation (as discussed on another thread):

Do advise the CAA (ideally address the Chief Executive directly) about TCs disregard for the "ruling".

Send them a copy of the boarding pass stub (which has your name on it?) with a NBA giving 14 days to respond.

Yes, 32 hour delay, by the time vegas said we couldnt set off had been delayed for 13 hours.

We were stuck in manchester not having set off yet as our plane got used for the cuban flight the day before who had engine trouble. They were delayed over night, used our plane and gave us theirs,so we were delayed etc etc knock on effect.

the schedule we have receieved simply says vegas wont let us land as no slots. v busy due to bank holiday . Im assuming that if we hadnt been delayed in the first place this wouldnt have happend but im just trying to cover all avenues now as im getting v nervous.

    thanks

No. You could undertake an SAR (forum search) if they require further proof.

I currently have a case for the Cuban flight going through the court. My case was stayed until after the jet2 vs huzar hearing.

Let us know how you get on as a couple of people on here will have an interest in your case. Good luck!
