    The defence is bunkum. But I can't write all the reasons why down here: you are going to have to set aside at least two hours, with a beer or two, and go through the thread. Lots of posts where people have picked apart defences that look like yours.

    If you are taking this to court yourself it is A LOT of work!

    At face value, it appears to be the former. Compensation isn't due if you benefit from some discount not available to the public, eg for staff. (Article 3(3)).

    Can anyone tell me what is Thomas Cooks address for sending legal documents.I have now got to the point where I need to go to the small claims court.On another point has anyone claimed for a flight from Manchester- Djerba on 24th Sep[tember 2011?

    I wouldn't start court action until you've digested the FAQs. TCs address is in the FAQs ...
  • Anyone out there had the long delay with thomas cook on the return home from cancun sceduled for the 1st july 2009 i beleave the flight number going to cancun on the 17th june was TCX72L but unsure what it was coming home. Also please someone let me know when planes are exchanged at airport do the TCX numbers change also

    sorry for taking up your time in the first place! ...subsequently did the search of all items around 'voucher' and could see I was on good ground and it mentioned ringing them. I have just done that and they appear to have caved in - they don't do cheques but wil do BACS payments and have asked for account details so they can process it. I will come when I get paid but it is looking good! Thanks again:)

    Hi All

    found out today that my local D Judge has NOT stayed my case. T COok wrote to court asking for it, and he has stated it wasnt a formal application, I opposed it, it wasnt appropriate to be dealt with by way of a paper application and will deal with it next week in Court.

    Am well aware he may still stay it once we all arrive at court but, fingers crossed.

    Anyone got an tips re immigration. one of the defence heads is that the airport in Las Vegas wouldnt let us set off (due to the delays) or give us a slot and this was an 'exceptional circumstance' according to Thomas Cook. Surely this is quite common in the day to day running of this type of business but am struggling to find anything on the internet with specifics. I just want to dot my i and cross my t!

    Any help much appreciated.

    Hi all was wondering if any members could help me I was delayed over 24 hours from His to manchester. Following advice on here I used the template and sent all documentation to Thomas Cook they replied citing extraordinary circumstances. I then followed next procedure and wrote to CAA who after ten months I received their findings yesterday which were in my favour. They have advised thomas cook to pay compensation but they are refusing. Is it worth going down the route of court action as really unsure which way to go now. Thanks in advance for your help.
